This letter refers to your application for Restoration and a Study Permit.

Based on your application and accompanying documentation that you have provided, I have carefully considered all information and I am not satisfied that you meet the requirements of the Immigration and Refugee Protection Act and Regulations. Your application as requested is therefore refused.

[X] Immigration Legislation requires that every foreign national in Canada must hold a valid passport, identity or travel document. As a foreign national in Canada, you have not produced evidence that you are in possession of such a document and that it is valid for the duration of your stay in Canada.


This is my refusal letter, and I attached all the documents which are required, including my travel document, because my passport which I used to enter Canada was stolen in Canada, so I replaced a valid travel document to apply for a study permit. However, I didn't know what should I do next, my program will start in September.

What travel document did you place? You don't have any copies of your passport you could have included while you wait for new passport?

A Chinese travel document which looks like the passport with all the information and I also attached all the copies of my passport. I need the study permit to replace a new passport.

That's your issue. Your travel document is only valid 2 years. The travel document you hold must be valid for at least the duration of your intended stay in Canada (which is 3 years) in order to get a study permit approved.

Given your studies are supposed to start in September, I don't see how you have time to solve this. I think you need to defer your studies to January, return home, get a new passport, and then reapply for the study permit. You can't fix this from within Canada.

Your embassy requires a study permit to issue you a new passport? That seems strange, have you gone to the Chine consulate/embassy and explained to them your situation, they might be able to help, get a police report of stolen passport.

Also I would call IRCC and explain that you did include the copy of the passport in your application so the rejection does not seem correct, maybe they can reopen it.

I understood what you said. However, I have enough time to replace a new passport oncewhlie I get the study permit, or I can take the summer break to go home to replace it. I confused it should not be a big issue because even my stolen passport will be also expired in less than 2 years, I also need to renew a new one during the studying periode.

All of them only issue visitors for a travel document. I showed to them all the paper I got from the police. They didn't think about that way.

If you want to try to get a study permit for September, the only option I see is to return to your home country immediately, get a new passport as soon as you can, and then apply for the study permit. Again, don't think anything is possible from within Canada.

thank you. it seems impossible. All of them will be taken at least 8 weeks. Thank you. It's very frustrating.

Is this rule only when applying for SP in Canada? Because my study permit application says passport only needs to be valid for six months, it does not seem possible since most countries will not renew your passport until it has about 1 year left, which means a lot of people would be unable to study.

Scylla's advice seems to be the best thing left to do now if that's the rule.

I don't know. However, my travel document is valid for 2 years. The confusion is if a 3 years program study permit must be applied with a passport or travel document which will be still valid for more than 3 years? It does not make sense at all. I searched the IRCC help center there is no explaination about it.

Did you talk to IRCC and did they explain the rejection reasoning?

yes, I asked IRCC but I didn't metion about this time periode problem. I didn't realize it was a problem because people can replace or renew it on time with the study permit.
