Hi everyone!

We're about to send our Inland Sponsorship and I have a few questions to you all master wizards that already had the experience applying, waiting and interact with the CIC.

Just to give a small context. We've been together for a bit over 1.5 years and getting married now officially with all wedding add-ons that every couple loves! One of us is a PR and the other on an "out of status" for 10+ years in Canada.

We're aware of all the supporting documents, extra detail to fill forms, how to send it and that we do not apply for the work permit, since current status.

We've all the official supporting documents required. Joint-accounts/bills, photos, bills, social foot-print, letters of family/friends, wedding contracts, just to name a few. We will send our application soon.

Is there anything we should be aware of? Any tips or advice would be appreciated.
Any of you have a good current template(s)?

Honestly. Just really read the guide. It is so straight forward and it walks you through every question. The amount of people who don’t surprise me. Anytime I was lost the guide clearly laid it out in conjunction with the check list. It literally tells you where and how to sign, when to write Na etc. Just annotate everything and make it clear and concise. Download a new checklist before you submit to make sure it is the most current and forms haven’t changed.

What do you mean by out of status for over ten years?

Visa expired,
Been in Canada illegally for over ten years? If so you should seek legal advice before making any moves on your application. Over a decade is quite a long time to be in Canada illegally and could cause you problems down the road once you apply.

Your visa expired doesn't mean you're out of status, your residence permit is your status.
? If one of them is a PR, that person would be the sponsor as a permanent resident of Canada. The other person, it sounds like, was on some kind of visa in Canada which expired over ten years ago. If what OP is saying is correct, that person then stayed illegally in Canada for over 10 years, and is out of status.

Op needs to be clear, the other person could be a Temporary resident.

Op needs to be clear, the other person could be a Temporary resident.

It was legally allowed to the country with a Student Visa and then expired.

So just to be clear...if, over ten years ago, your partner was allowed in on a student visa that subsequently expired and he remained in Canada illegally for over a decade, you should seek legal advice before you apply. There is a list of risks/issues you need to be aware of and consider before applying. Because the individual has been here illegally for so long, you have a more complex case then a simple, straightforward spousal sponsorship application.

Did he/she applied for renewal of study permit? Visa is different from permit, the visa allows you to re-enter canada but permit allows you to remain in canada.

We already did! We went to 4 very renowned lawyers. There are some specifics but nothing they can do that would justify a 10k+ bill.

You can try approaching community legal clinics that offer services that may be more feasible. I would not apply expecting the process to go all that smoothly, given such a long overstay. Wish you all the best!
