Hi all. I have been in Canada on an LMIA (employer specific) for 4 months. My Work Permit is for one year.

Recently my employers have started to get quiet with their workload and it’s looking like there is going to be lay offs very soon.

My question is, if i get laid off from this employment, can i remain in Canada while I attempt to secure another LMIA or would I need to return to the UK and wait?

Also I have recently submitted a full PR application after receiving an ITA via Express Entry based on a Federal Skilled Trades Invitation.

Thanks fir taking the time to read.

Yes - you can legally remain in Canada for the duration of your work permit validity. Once your PR application is accepted and you no longer have employment with your current employer, look into applying for a BOWP (bridging open work permit) and provide evidence you have been let go.

Thank you very much for the reply.

Would i be able to claim any support to help me pay my rent and monthly bills during the waiting period?

I’m fortunate that I’ve never been out of work long enough to ever claim financial support while in the UN but as i am tied via LMIA I’m not 100% sure how it all works in Canada.

It's hard to say if you will qualify for EI (employment insurance) or not. To qualify to apply, you'll need to meet the minimum insurable hour requirement (i.e. have worked enough hours) for your province which varies from around 450 to around 750 depending on location. There is also a requirement that you be looking for work and 'available' in order to receive EI. Those on closed work permits will sometimes get denied because they aren't 'available' (meaning they cannot simply start working). I would look into applying for the BOWP as soon as you can.

Hello Rod
I have a question, I will appreciate if you’re able to answer it.
When did you receive your ITA?, I’m intending to create a profile for EE under the Federal skilled trades programs too, I am just not sure how often they invite FSTW to apply...
Thanks in advance, and good luck with your job issues.

Hi Margotte,

There was a trades draw at the end of May. Judging by last year the next one will be around September/October time but this isn’t a guarantee. My advice is to get your IELTS completed as soon as possible and create your profile.

Yes, I am studying to have it ready soon, by the way which test did you have IELTS or CELPIP? Was it hard?
Thanks again
