fairness letter for medical - parents visitor extension

Good morning,

Forum members please help me.

I am writing about my parents. They are here in Canada with me on visitor visa. We applied for extension of visitor visa in back in June. My dad has some health issues like heart disease (stable), long history of diabetes (well controlled), kidney disease due to diabetes (stable).

My dad had hospitalization back in 2016 and earlier this year, but stable now.

I got fairness letter and they wrote
Before I make a final decision, you have the opportunity to submit additional information that addresses any or all of the following:
 the medical condition(s) and;
 your individualized plan to ensure that no excessive demand will be imposed on Canadian social services for the entire period of time requested in your application and your signed Declaration of Ability and Intent.

What do i do. Please help.

i am so worried and confused.

we are four siblings and all are here with very good jobs and financial condition. Please suggest what can be done.

You need to show that you can afford to pay for his medical treatment so that the taxpayers of Canada don't end up footing the bill for him.

Was you father in hospital here in Canada this year? If so, how did you pay for it?

For hospital stay in Canada we paid through the insurance they had.

My parents also have permanent residence file in process and they got medical done for permanent residence. After receiving medical my father got request to get letters from all the doctors asking about his health status. We got letters from all doctors plus CIC wanted to him to repeat x-ray in 3 months that will be in September.

How do we prove that we can afford to pay.

You most likely won't be able to get coverage through insurance again since these are now pre-existing conditions. You need to show that you can pay for the care they need out of your own pocket. I would research what the hospital stay cost, as well as any other care he received that was covered by insurance - and then try to demonstrate that you would have sufficient funds to pay for all of this (plus more) if he has issues again.

Just double-checking that the procedural fairness is due to the TRV extension. I would include copy of travel medical insurance. Proof that you have been paying for all his medications in Canada. Paid bill from hospital stay. NOA from all 4 children. Not sure how long your parents your parents have been in Canada on a TRV but he is a visitor so isn't guaranteed an extension.

Would expect that this will also be an issue during PR. I would be really concerned about his kidney function because CIC wants to avoid people who will need dialysis. Cardiac issues will also be a concern.

For PR application, we already got letters from all doctors saying he is stable and waiting for x-ray that is to be done after three months from the original one.

The letter we got is for visitor extension. Parents originally came to Canada in May 2016, stayed till August 2017, had super visa at that time. Went to home country for 4-5 months, applied for new visa as their supervisa expired. Then came back in December and applied for extension in June - because they have visitor visa now.

I will call hospital today and get the letter that we paid for the hospital stay in 2016 and will also call insurance company to make sure they expedite paying for the hospital stay he had this year.

As for his kidneys, his kidneys are stable for very long time. I mean he is at where is, near normal range for his kidney numbers.

For first hospitalization everything paid by insurance. For second hospitalization, making payment is in process. Hospitalization - both times related to heart issues - congestive heart failure - but doctors said that my dad is not a surgical candidate so he will be managed medically. He is on medical management and stable.

Also of note is we used all his insurance for the second hospital stay, I mean maximum limit we can use, so technically he does not have insurance any more. You think getting insurance done make any difference?

How do I show them I will be able to pay. Do I need bank balance in my account or what do I do to show them.

They mentioned in letter about the dollars amount per year to be under 6387 dollars per year, but according to new rules it is around 19000 dollars. Do you think it is a mistake or they gave limit for our case of 6387 dollar per year.

He has spent a significant time in Canada over the past 2 years so not totally unexpected.

If extension is refused, what are our options. Can they go to US and come back as they have 10-year multiple entry visa or you think even that entry will be denied? Also if they refused can we apply for H and C and can they stay here till application in process or if we dont apply for H and C can they stay here as their PR application is in process. We have no one in our home country to take care of them and all our family is here.

It does say that it is for visitor extension.

For PR application we got medical furtherance a month ago, they want letters from all doctors about his medical condition and also want repeat x-ray and sputum test.

The medical limit is different for temporary visas vs PR.
