You can check with a specialist and get additional/ substantial information about your case (before appearing for the medical exam) and submit the same to PP during IME, that should help in faster processing of the application (at least the medical evaluation part of the application); and may be in some cases - additional review by another doctor may not be required.

Only information? Or reference as well in advance?
Actually I am medical doctor myself.
Yup my CD4 level was close to 500 (460). And viral load below 400 cp/ml
Well Dr @Outworld, you are definitely more knowledgeable than me in that case. ;)

And If you already have a local physician doctor (following up your case), have those investigation reports and his observations handy. You can submit them to the Panel Physician during your initial IME.

@Outworld - I have some info for you regarding your statutory query - "Have you had any serious disease or physical or mental disorder?". HIV virus is not considered as danger for public health in Canada.

refer to the article, section 6.1 (notes mentioned below) - https://www.getgcms.com/blog/medicals-preparation-expect-diagnosed-ailment-comprehensive-post/
6.1 Danger to public health
For inadmissibility under the ‘Public Health’ factor, it is evaluated whether the applicant is affected or carries any communicable disease; and the impact that the disease could have on other persons living in Canada. (R31(b-c)).

The conditions which are likely to be a danger to public health are, active Pulmonary Tuberculosis (TB) and untreated Syphilis. If the applicant has either or both of these conditions, they will likely be found inadmissible on the grounds of danger to public safety, unless the applicant is treated according to the standards laid down by Health Canada.
Human immunodeficiency virus (HIV) is not considered a danger to public health.

The article is from people/ group who studied the GCMS notes extensively. so very much reliabale i believe. Please mark you EE SQ answer as 'NO'. Hope the above info is helpful for you :D

I also believe that it should have been No because HIV doesn't pose danger to public.
But others advised me to answer Yes.
You know I think if I answer Yes that means that I consider myself as a danger to public as if I am a sex worker:)))
Are u sure if answering no they wouldn't consider misrepresentation

@Outworld - At first i thought the same, and started digging into details. As per the people dealing with GCMS notes, HIV virus is not considered dangerous (as per Canada immigration), unless it is in stage 3.
You have three options-
  • Give SQ answer as 'No', and try mentioning one or two lines in LOE, why did you answer 'No'. This would give you a chance, if the Visa officer still thinks different and asks you fill an additional form
  • Wait till you undergo immigration medical exam, ask the immigration medical doctor ONLY, no one else (since it should be confidential) about how you can answer the question in EE application.
  • Last option is to give SQ answer as 'Yes', and include few details in LOE (optional)
In all the cases, share the previous doctor notes and investigation results with the PP during immigration medical exam.

Is it possible to undergo medical exam without having completed the questionnaire of Statutory questions and trasmuting data?
How medical is done?

@Outworld - Once an applicant has an ITA (invitation to apply) from IRCC (for EE application), he/ she can take a copy of the ITA & their passport copy, book an appointment with Canada approved - Immigration medical exam center.
After completion of medical exam, the doctors office will provide an e-medical copy of the medical (which includes the list of tests conducted) to the applicant.
The applicant has to fill the PR application forms (including the standard statutory questions), generate checklist and upload all the required documents in the online application (medical form is one of the row in the checklist documents). Once the applicant has uploaded all the documents, he/ she can send the application (i.e. transmit the documents to IRCC) for validation and pay the application processing and right for Permanent residence fees (RFPP can be paid later as well, when IRCC requests for the same- not much impact on the timeline i believe).
IRCC will start processing your application, once the applicant pays his processing fees.

In PR application-
  • Applicant can modify the application form details (including statutory question details) and regenerate checklist documents anytime and any number of times, before submitting the application to IRCC
  • Applicant has complete control over the PR application documentation (update and change checklist documents), until he submits the documents to IRCC (by paying the processing fees).
Let me know, if you have any particular queries. I will see, if i can help and answer the same.

I would like to share my case, hope the best outcome to me and you as well.
I got MR last week, and I am in medication with chronic hepatitis B. Since last June I started taking Tenofovir once a day; even at the time of starting medication, my liver function test are normal, HbsAg +, HbeAg +(<10 S/CO); anti HbeAg -; viremia load undetectable. Every 3-6 month from that time up to now, I check regularly my virus load and found nothing.
Before going to attend ME, I go to internal medical doctor ( of CIC designated panel physician center) to check again all LFTs and virus load, the specialist suggested me keep on taking tenofovir once a day and a follow up every 6 months due to everything normal and in good quality of life.
Last 11/5/2918; My family go to check our health as appointment with panel physician. All medical reports are disclosed to them, they said they will check my liver function tests only, others now are not required ad per CIC instructions. They will send all of my history reports and in the case CIC need to do more test, they will inform me.
I am now waiting and hoping for the best, and in my mind, I believe that I can benefit with new policy and possibly the reduced cost of tenofovir as the pattern expired in July.
I will update when anything changes!
Hope our dreams come true!
Best regards

I was living in worrying and sad for my application. I searched for the answers but no much positive and clear results since someone can pass MR with their hep b inactive carrier stage or they are under sponsor category (no need to worry about diseases like hep B). Therefore, I post my case just for people like you, you can be inspired by my example and apply for your kid’s future.
You will be there, 100% successful in Canadian pr application!
Best wishes for your family!

It is important to remember that although cases may appear similar each person has a different disease course and health history so there is no guarantee that they will qualify but there is definitely a chance.

Did you get visa? My wife has HIV with an undetectable viral load. The migration officer mentioned that the expected cost for health related services for this applicant is $9,778.35 per year. This amount exceeds the average per capita threshold of $6,604.00 annually. Yet I did not submitted new medical reports. My application is accessed as per old rules. Is my wife is eligible for the criteria of new rules?
You just recently were given a procedural fairness letter so yes the new criteria would have been considered. The issue you are a student. Spouses of students have to meet a different criteria. All temporary residents due. As a PR she would be approved.

As I have promised I will update any news regarding my medicals.
So everyone will know the approach of IRCC Tor HIV positive PR applicants.

People may be on slightly different therapies. As mentioned before medical inadmissibility for PRs is not the same as other temporary residents like students. The new criteria is for PRs. The rules for temporary residents are not as obvious.
