Legally separated but no separation agreement

I received an email today from IRCC requesting my mother's separation agreement from my father but there is none. They are legally separated as they don't live together since forever. They verbally agreed to continue having it that way in 2006. What do I send to IRCC since there are no separation agreement?

This must be received at this office by: 2018/08/13

You could write a letter explaining the situation and provide that in lieu of a formal document.

It would largely depend on the local law as to whether your parents are legally separated, but most often there has to be some form of official document for this to be recognized internationally. For all intents and purposes, Canada may still consider your parents married.

As mentioned above, your mother need to have an official separation agreement that is recognized by government that she is legally separated. This is to prevent your mother from being able to by pass the family sponsorship and sponsor her legal husband despite being separated. With this document, your mother will be able to land as PR without any ability to sponsor her separated husband.

Thanks for the reply will be giving that a try. She wouldn't need to and can't even sponsor him because he is already a Canadian

Then it is all moot point then. However I am curious as to why the Canadian husband (your dad) didn't sponsor her for PR in the first place.
