Dear All,

Unfortunately my friend Convicted for Two Days under Drink and Drive (DUI) Case in india ,He already Completed the 2 days as per Conviction,Being a CANADA PR VISA Applicant,Will This case Effect his PR Process if so then at what Stage and What are the solution to tackle this situation . PLZZZZ Advise

#This is his 1st time and his blood alcohol content (BAC) was 43 point. Pls advise .

The BAC limit in Canada is 80. So unless there were other signs for impairment that were introduced as evidence in the case the conviction will be deemed not equivalent to a DUI in Canada and therefore still admissible.

DUI is very serious I hope your friend has learned from his mistake.

as long as the PCC gives him a clean chit, he is all good, else its an issue. try to apply for PCC , then you will have a clear idea

The federal court has a case listed for an Indian man who failed to disclose arrests, dismissed charges and a conviction that was overturned on appeal. The man has no criminal record and suffice to say a clear PCC, but nevertheless the Canadian immigration forms ask for arrests and charges and even overturned convictions, and this was on a TRV application not a PR.

The best course of action for the OP is to get a legal opinion from an immigration lawyer about admissibility and include that in his application.

Can you please update on how it went?
I have a BAC of 0.044%(43mg) in India in march 2020 and haven't received the judgement as courts are currently operational only for unguent cases so Im waiting for the judgment to apply for a study permit and I would like to know how it went for your friend

Have you got the study permit? does it affect your student visa application?
