Is there nothing we can do if PGWP is refused 90 days after graduation???

Hi,
I am curious about the applicant options if he/ his PGWP is rejected.

For eg: Graduated on Sep 06. Applied for PGWP on Sep 20. Say processing time: 120 days. On Jan 20 his PGWP was rejected. As per regulations he cant reapply as he exceeded 90 days period .

The reason why I am asking is PGWP are being rejected for a simple reason of not attaching completion letter or transcripts. I know these are important documents, but every body does mistakes. I think second chance has to be given.

Any comments??

CIC doesn't really allow exceptions to the 90 day rule. For this reason it's really important to review the application process and submit a complete application.

Thanks Scylla for your reply. Just one more question. Is it okay to flagpole for pgwp after applying online??( Due to heavy processing time)

Do I need US visa to flagpole also I don't hold an visa exempt passport. Can I flagpole??

I know some people here have flagpoled successfully - others have not been successful. I don't have any experiences myself.

Hi Scylla,
Need your advise.My situation: Graduated on 06-Sep-17. Applied for pgwp online on 20-Sep-17. Went back to India on 22-Sep-17 with my family. Planned vacation in India til Jan 22.I had a study and TRV valid till 2019

I called CIC about my appliction on Nov 28 as there was no update on my applicatin ( Applicants applied after me got their pgwp approved. From this forum I came to now that applicants who applied between Sep 15 to Sep 22 got their pgwp approved around Nov 16. I also got an application update email on Nov 16, but no messages in my CIC account). The agent told me that I have 2 UCI numbers. My study permit and PGWP UCI no. were different and this is the reason its taking too long. She also said that they have to merge those two to one UCI no. I told her that I am in India for that she said that I have to come back to Canada with in 90 days after my graduation i.e Dec 5, as study permit get void after 90 days no matter how long it was issued for.

So I came back to Canada on 02-Dec. At toronto airport immigration officers seems not much concened about this rule. They asked me why you came back so early while my pgwp application is in still process. The officer said that there is note on application about 2 UCI no. but still no update.

Is there any thing I can do except keep waiting on outcome of my online application?. What are the chances for refusal. I am hoping that the officer might have seen my file on Nov 16 but made no decision. Correct me if I am wrong the officer might refused on Nov 16 itself if there is wrong in my application( like missing documets etc)

My family is still in India and I need to go back to India as soon as possible. What options do I have" How about cancelling this application and making a new one?? Flagpolling?? I am getting really frustated by CIC

Sorry - as mentioned earlier, I don't have any experience with the flagpoling process to get a PGWP and can't advise you. I would recommend you search the forum for historical posts on the topic. Good luck.

I don't think reapplying is a good idea given you are almost at the 90 day mark. If you wanted to reapply, your application would have to reach CIC before the 90 days ends. You're extremely short on time at this point.

To be approved for a PGWP - your studies must be full time. You can still qualify for a PGWP with part time studies provided those part time studies were only in your last semester. However it sounds like in your case the part time studies were in the middle of your program which would be a problem.

Yes I realized it . I however just applied again with a lawyer . In November . I applied for restoration and pgwp again. It’s weird how my friend got a pgwp he was part time one semester aswell during school year. His first semester . Anyways I look to God

Hey did you get your work permit? Was in a similar situation and applied on May 22nd.
Also how long did they take to give you your first rejection?

No I’m in waiting process of federal court have to pray I get leave granted . Mine was rejected 31august 2017 . But thing is i opened on cic n saw approved I then I relaxed. I then got my rejection letter in November . But still nothing . It’s a very long process and just have no1 but God to look to nothing else can save you from this . It’s officers discretion right .

Hey guys my situation is bit different... i applied my PGWP on 14th may and got refusal on 28 june 2018 saying that they did see enough documentation of completion of my studies though I submitted my letter of completion of studies, but I was still in 90 day period of completion of study so I applied again on july 5th. I’m still waiting for it. Is there anything eles i should i do? Please suggest as I’m really worried.
