Dear All,

Sorry for a little lengthy post....

Me and my boyfriend are indian. We are in a relationship for last 12 years ... Now, i am in India and he is a PR in canada. We were thinking of doing a court marriage so that spousal sponsorship process can be started .. we are thinking of rituals marraige after some 7-8 months ... Please guide me if court marraige is enough for spousal sponsorship... Is rituals marraige, honeymoon pics mandatory ...

Please help with your valuable inputs.

I was in similar situation to you last year and it was also a lengthy relationship like yours. However I was not recommended to do the court marriage to apply for sponsorship - specially being an indian, processed by NDVO. In India, marriage is still considered a big thing with all the style and grandeur for the most part - so they consider a register marriage is a red flag.

If you are working full time in India, first try to get a visitor visa to Canada. Get engaged(we skipped the engagement ceremony because our families approved it right away and we didn't see a point in having this then wait few months for wedding plus taking time off was an issue for me) and then get married as per your tradition, then do the sponsorship.

If you get your visitor visa approved, what you can do - is apply as inland spousal sponsorship applicant after the wedding - so you dont have to be away from each other (we did outland for other reasons and it was bit hard but we visited each other few times). Else you have to do outland app and try for visitor visa later during the process.

Meanwhile, collect all your relationship proof for 12 yrs and explanation of timeline of relationship (plus why you chose to date for so long if you are say above the average age of marriage in india - i.e. in your 20's).

We got pre-arival and decision made by taking this approach (minus the regret about inland application) and we are awaiting passport request now.

Will this be a issue in the process ?

Would like to understand how many months did it take for spouse PR in your case since it was outland application?

We are considering outland due to obvious shortcoming of inland visa ..

Also, I couldn't understand the term 'application being processed by NDVO.: and Pre-arival.... please help me with this ..

What is the relationship history?

A court marriage is generally a huge red flag for Indian couples.

We applied in august 2017 and almost at end of our wait - waiting for passport request to issue the PR visa papers.

NDVO - New Delhi Visa Office - This is where application gets processed for an Indian National spousal sponsorship living outside Canada.

Like you, just 2-3 months before our wedding we talked to my immigration lawyer (& others) about doing a court marriage in Canada(or India first after engagement) and they all strongly said no, we need to put our best foot forward with this application. That is the reason we prepared evidences, proofs and then applied 40 days after wedding.

Indian marriages in court is considered a red flag, because it is not inline with local culture and tradition. Also you need to explain with a good reason why you didn't do that.

The answer to this is yes this will be a red flag -in our culture, these are considered as important step that actually means you are married. So they can reject on that basis, which they often do in middle east.
