Hello,

I am about to apply to express entry, my current legal status is married.

Having said that, my wife and I are nearly separated and we'll finalize the divorce which will take anywhere between 2-4 months.

I'm not exactly sure how I should go about submitting my EEP.
Keep in mind, she doesn't know I'm applying to Canada.

Should I put my status as "married", and later on update it when I obtain the legal divorce certificate? (I don't know if that is difficult process to change such data).

What if I get lucky and I get invited while we are still finalizing the divorce?

Your guidance is appreciated.

You have answered your own question.

You should truthfully disclose your current status as married when applying EE. And once you divorce, you should update the CIC about the status change. Anything false that you declare can lead to the CIC to come after you at anytime even after you become a canadian citizen.

It is indeed a difficult and a long process to change that status during application processing but that is the only right way to do it.

Or you could defer your PR application until all things are sorted out.

In your EE profile now, you should declare you are married, as that is your marital status. If you get an ITA before your divorce, then you have 90 days time to change your status (finalise divorce) before submitting your PR application. You cannot submit your application without your divorce, as you have to submit your wife's documents such as PCC, medicals, passport etc, which I assume is not possible in your current situation. The best option is to wait for your divorce to be finalised and then create your EE profile as 'Divorced'.

No, not yet.

For personal reasons, I can't file it now.
But once I file it, it only takes days to do it legally.

This is why I'm asking what is the process exactly pre-ITA, and post-ITA.
Mention married for now and later on raise CSE to update profile as divorced.
