dear friends..
I have applied for express entry to canada and i have received my ITA on 23 May 2018 and have few days left to complete the pending formalities.
Prior to my application, i visited New Zealand on STUDENT VISA in 2016(6 April 2016) and was convicted with DUI in NZ court on 6 october 2016, and i was charged 6 months ban on driving along $420 fine. I made the payment and got my license back post expiry of 6 months bans.

Moreover, I was issued a DLN (Deportation Liability Notice) by INZ (Immigration New Zealand) on 21 March 2017 for hiding my prior refusals for student visa to canada while applying for student visa to NEW ZEALAND.I did file an appeal in the IPT(IMMIGRATION & PROTECTION TRIBUNAL- NEW ZEALAND) to justify that it was my agent who had not disclosed the relevant information and gave plenty other reasons how this deportation would affect my future, but unfortunately my appeal was not accepted & I was asked to return back to INDIA , otherwise I would have been deported.

INZ(IMMIGRATION NEW ZEALAND) gave me the option to reapply again for visa from INDIA if i wish to enter NZ again and leave the country voluntarily, which i did so and turned back 0n 27 June 2017, & instead of applying for NZ, I got married in September 2017 and applied for EXPRESS ENTRY PROGRAMME along my wife.

I just wish to know how these 2 past conditions can affect the present status of my application & what in turn do i need to do or what safety measures do i need to follow in order to be successfull..

Hi Inder,

So this is going to be a tough situation for you. As I understand, you have lived more than 6 months in NZ (and during that time you had two infractions - one DUI and one related to hiding prior refusals from Canada). Canada Express Entry process will ask for PCC (police certificates) from all countries where you'd lived more than 6 months - and once it shows up in NZ PCC report, the Canadian authorities can use it as grounds for 'criminal inadmissibility'.

And also, somewhere the Express Entry questionnaire also asks whether you were ever refused a Canadian visa (which is your case is true).

I think you should provide all the information in detail, and then see what additional info/actions do the Canadian authorities take - but don't try to hide the info, if they find out then you risk being debarred from Canada for 10 years.

I hope this helps.

The DUI is a big problem. You are currently inadmissible to Canada (meaning you are not allowed to enter Canada due to your DUI conviction). To fix this, you'll need to apply for rehabilitation. However you won't qualify for rehabilitation until five years have passed since you completed the driving ban. So this means you'll be able to apply for rehabilitation sometime in 2022. You need to forget about Canada until then. No point going ahead with the ITA. Your application is going to be refused.
