Father was sick , RO not met, I want to apply for a PRTD how do I go about this?

Dear all,

I haven't met the residency obligation and got 550 days in Canada in the past 5 years. I am a PR since 7 years. I am outside Canada and want to apply for a travel document. How do I go about this?

My story: I exited Canada to take care of my father who was suffering from toxic depression and diabetic problem which was causing a huge burden in his everyday life and he was unable to perform day to day job. My mother doesn't live with him and she separated and went to another country. My questions as under:

1) Do I have to show IRCC about the medical conditions and doctor reports etc? If yes what do I have to show? I have limited number of reports roughly 3-5 pages reports and that's it because I guess some of the medical reports was lost in transit while traveling. Is diabetes and depression considered weak disease to be approved for PRTD? Is there anything like strong and weak disease according to IRCC criteria? I mean to say Cancer is definitely a strong disease. Do IRCC discriminate diseases? I know common cold is a seriously weak disease.

2) How do I show IRCC that nobody was there to help him in such time? Does IRCC officers visit my father's house to see who is living there?

3) how do I show IRCC that somebody was required to take care of my father at such time? What kind of document is required for this?


4) What is the best way to handle this case in order to make sure I am approved for a PRTD? What is the secret recipe? How did other pr holders manage to get approved under humanitarian ground except minors?


Any thoughts, suggestions and replies is highly appreciated.

Is CCTV footage good to show that I was the only one helping my dad at such time? Do they accept cctv footage?

No they won't accept videos. This wouldn't prove anything anyways.

You need to have doctors, hospital, specialist reports etc going back at least the 3 years you were outside Canada. Doctor reports should show the specific diagnosis, and indicate that your father needed a family member to take care of them for their medical condition. Medical condition should also be serious enough that regular follow-up appointments were done during the length of time he was sick.

You will need to also explain what other family members live in his city. Were any of your siblings living near him? Or aunts and uncles? If not, then you would have a good case that you were the only one available.

Also you should show that he no longer needs your care anymore so you are free to return from Canada.

It's up to you to put as much proof and evidence together to submit as a H&C reasons when applying for the PR TD. Put in as much as possible. If you lost documents, contact the original place that issued them to ask for replacement copies. It's at discretion of the visa officer if they will accept the H&C reason or not.

No, IRCC have always made it very clear that they will only accept paper documents/photos. If other media are supplied, it will either be ignored, returned unviewed or destroyed.

I breached the ro recently in the past year and that's when My father got sick. So how do you justify the time you spent outside Canada, before your father got sick? Sounds like his illness had nothing to do with you being in violation of the RO.

What I mean is after he got sick I left Canada to take care of him in the past year. I was almost about to fulfill the ro but all of a sudden my father got sick and I had to leave Canada which brought me down to 5-6 months short and at the same time pr card got lost in transit. That's why we have the report from the past year only. And now he is doing well and no more issue, that's why I want to return.

You were already in violation of the RO when you left, so you really have no case. You need valid H&C grounds to cover the ENTIRE time you failed to meet the RO.

No, when I left Canada last time on that particular day, I had 2 years 2 months so I wasn't violating the ro. After I left Canada the days move from the window and then only I breached the ro.

Well, to be honest the day I left Canada I had 2 years 2 months in my profile, so I wasn't violating the ro on the day I left Canada.

It's now when I am in breach of ro as I am now short of 5-6 months.

Still doesn't change the answer. Why didn't you have 4 years when you left Canada? Because you spent time outside previously. You need valid H&C reasons to cover all absences for the last 5 years. You could have still been in compliance with the RO now had you spent more time in Canada earlier in the 5 year window.

So seems like the majority of your time spent outside Canada (more than 2 years) was for personal reasons, and just a small portion (less than 1 year) was for family illness. This is why you should not "cut it close" when it comes to the RO, you never know what unexpected situations will arise that will cause you further extended absence.

You can certainly submit the PR TD application and hope for the best, but be very aware there is a chance it will be denied and process started to terminate your PR status.

You will need to submit as much proof as possible and hope the visa officer accepts your reasons.
