Hi all,
My husband and I got married in january of this year. I wanted to renew my passport with his last name since it will expire this November but it will take approximately 6 months to have it changed in my country and we got our marriage certificate in March. So if I will do the name change, it will be done by September and my spousal application will be submitted by October and mind you my open work permit (PGWP) with my passport will expire on November. Should I be worried that my new passport that will be used for the spousal sponsorship that I will submit by June is still under my lastname before marriage?
And lastly, I am still holding an open work permit (PGWP) until November. When I submit my spousal application, will I also submit an OWP application or just change status or extend my OWP/PGWP?

Hi

Submit it now with your current passport and just update the app once you get your new passport.

Work permit form is IMM5708.

Its not mandatory you change your surname.........its not a problem if you use your maiden name in your spousal sponsorship application.

When you fill the sponsorship forms you are required to fill your name as it appears in your passport.

If you renew your travel passport and change your last name from Maiden to your husband surname in your passport, you must inform IRCC of the change......you will need to send a copy of the new passport data page through IRCC webform to the VO processing your sponsorship application.

Its not mandatory you include a copy of your travel passport when you send your spousal sponsorship application........but you have to ensure a copy of the passport data page is sent to IRCC before the PR visa is issued.

Refer......Spousal Sponsorship Checklist.

Note: Although you do not need to have a valid passport or travel document when you submit your application, you must have a valid travel document or passport to be able to travel to Canada and to be admitted for permanent residence. You will need to demonstrate that you hold an acceptable travel document or passport before we can finalize your application.

If you decide to apply with your Husband Surname as your Surname........you do not need to include your current passport as it has your Maiden Name........but you must ensure your passport is renewed with your husband surname......and must send the new passport to IRCC before your PR visa is approved and issued.

You currently hold an open work permit (PGWP)..........i guess your spousal sponsorship application will be INLAND..........will advice that you send Spousal Sponsorship now with Open Work Permit (OWP).........OWP takes around 4months.

If your send your spousal sponsorship application in June 2018.......and all documentation is complete.......you will receive AOR from IRCC Mississauga within 6 to 8 weeks (Aug 2018).........and OWP in 4 months (Oct 2018).

WHOAAA THANK YOU FOR THE DETAILED EXPLANATION!! :)
I think i will just use my maiden name on ALL APPLICATION FORMS because my new passport is still on my maiden name. 1. However, I already used my husband’s last name on my driver’s license and our internet bill. I will include them on my supporting documents for shared expenses. Will that be a problem? They might be confused as to which last name I am legally using. Like I said on the thread, my passport renewal for new lastname for married citizens (Philippines) will take approximately 5 months and I will do that once I submit my spousal sponsorship.
2. For the OWP, I will include it along with the spousal sponsorship because as I was checking my eligibility for OWP, it says there that if I already submitted an applicator for permanent residence. And that allowed me to have an OWP. Wheb I ticked NO to all the questions regarding my status here, it didn’t allow me to have OWP it just allowed me to have TRV extension.

You could apply for your maiden name.........its won't be a problem........and you could include your new driver’s license and internet bill as supporting documents for shared expenses.........maybe you include a note on a sheet to explain that you plan to change your last name, and have started with your driver's license.

After you renew your travel passport and change your last name from Maiden to your husband Surname in your Passport, you must inform IRCC of the change......you will need to send a copy of the new passport data page through IRCC webform to the VO processing your sponsorship application.......

Okay thank you so much for your help!!! Another thing on my application for OWP, so I am still holding a valid OWP thru PGWP right? When I apply for OWP, is it for new employer even though I am currently working already? Unfortunately not NOC O,A And B.Because when I applied for my OWP for PGWP, that’s how I did it.

Your current PGWP is valid until Nov......when you apply inland for spousal sponsorship with OWP.......OWP will approved in 4 months after applying.
