Do I have to apply to Extend my status?

I have some questions that I thought you guys could help me, especially if someone went through the same situation.

I am from Brazil and I came to Canada with an E-ta (electronic travel authorization). According to the Canada government website, unless indicated on my passport, I may stay up to 6 months in Canada. On my passport I have a stamp that only says the date I entered in Canada. Supported by the website, my E-ta expires on June 8th, 2018, when it completes 6 months.

I came to visit my boyfriend(now husband) and friends. I was supposed to come back to Brazil but meanwhile I was here we got married and we are applying for the Permanent Residence on Family Class - Sponsoring your spouse inland. We already have all the package ready to apply.

We have someone that will review all the forms for us, but when I called her to make the appointment she said that I would need a valid Visa to apply for the immigration process, because the E-ta doesn't qualify as a Visa.

My question is do I really need to apply for an extension of my status here? Because on my application pack I am also applying for the Open Work Permit, which I understood it would already change my status. I am worried about applying for an extension of status and it gets denied for any reason. If so, we won't be able to apply at all. Once denied they would ask me to leave Canada and I don't want to go Back to Brazil and lose all this time we've been preparing all the forms and documents, paying the fees and also because they might not allow me to come back in the country.

Does anyone have any advise ? We have all set to send the application but I am not sure about applying to extend my status.

I filed my application at April 2018, but my visitor visa will be expires at June, so for safe, I applied for extension.

You should apply for INLAND Spousal Sponsorship when you have a legal immigration status in Canada.........so will advice you send your Inland Spousal Sponsorship application with Open Work Permit (OWP) to IRCC Mississauga before June 8th (when you have valid temporary status in Canada), and ensure its complete to avoid been returned later.........it takes around 6 to 8 weeks to receive Acknowledgement of Receipt (AOR1) from IRCC Mississauga..........so will advice you apply for extension of your visa.

It would have been much better if you has applied earlier, so that you would have received AOR1 from IRCC Mississauga before June 8th.

So you applied with a Visa and not an E-ta, right ?
Because in my case I have a E-ta that expires on June 8th. I was comparing the forms to Extend the Status and the Open Work Permit they are pretty much the same. What makes me believe I do not need to apply for the extension. Specifically because on the Extend of the Status form I would have to say when I intend to leave Canada, which I can't say that once I am applying for the Permanent Residence because I have the intention to live with my husband here.

My advice would be to stay away from that person. That is completely wrong. You have valid visitor status and do not need to apply for an extension before applying for PR. This is basic information, so the fact that this person doesn't even know that means STAY AWAY or she will likely screw your app.

You are only eligible to apply for INLAND Spousal Sponsorship when you have a legal immigration status in Canada.........so will advice you send your Inland Spousal Sponsorship application with Open Work Permit (OWP) to IRCC Mississauga while your visitor visa is still valid (i.e., before June 8th), and ensure its complete to avoid been returned later.........it takes around 6 to 8 weeks to receive Acknowledgement of Receipt (AOR1) from IRCC Mississauga..........so will advice you apply for extension of your visa.

Valid status is NOT required to apply for sponsorship.

I will add that many people apply to extend their visitor status as a backup in case the PR/OWP is returned. This keeps them in status if the app is returned.

We would have applied before, on April, but what held us was the wait for the marriage certificates. Sincerely we thought that with the E-ta I was fine, once the border agent stamped on my passport and the website says 6 months. But the certificates took more than a month to arrive. :(

I will add that many people apply to extend their visitor status as a backup in case the PR/OWP is returned. This keeps them in status if the app is returned.

Yeah.. my only concern is if they deny my request to extend. Because if it happens we lose it all. We found this Association in town that provides this service of reviewing the forms, we thought it would be nice having an extra safety, but when she mentioned about the visa we got confused. This whole process is so frustrating sometimes. You think you are all done, then something happens.

If op applies for owp BEFORE status expires they are on implied status.... just as they would be if applying to extend stay

The only situation where you would have issues is if the visitor extension is refused AND the OWP app is returned. You would then be out of status. Chances of that are very low.

I will reiterate that you should not take your app to be reviewed by this person. She doesn't even know the basics of status.
