Dear Friends,
I have the following situation with respect to Police Clearance requirement. I'm currently in the IELTS and ECA stage, but want to be ready with the foreign country PCCs.
For myself,
1. I've stayed in the US for 1 year between 2005-2006, i.e. before the 10 year cut-off period. I've again stayed in the US for 4.5 months during 2008-09. Do I need to get PCC for the US?
2. I've stayed in Australia for 1 year 4 months between 2007-08 and returned to home country in June 2008. I intend to create the EE profile in July 2018, i.e. just beyond the 10 year period. Do I need to get PCC for Australia?
3. I've stayed in Kuwait for about 1 year in total between 2013-15 across multiple visits. Each of the visits was less than 1 month duration and on Business visa. Do I need to get a PCC?
For my spouse,
4. She has stayed in the US only once for 4.5 months during 2008-09. Do we need a PCC for her?
5. Same situation as myself for Australia.

Could some expert please provide guidance on which all PCCs from above countries I need to get in addition to home country. I can then start the process accordingly.

Answer is No to all your questions.
Thanks a lot for your reply! Going through the CIC website, I'm also fairly certain that we should not require PCC for US and Australia. Not certain about Kuwait though, because in this forum, I've seen in multiple threads senior members opining that we need a PCC if we've stayed in some country for overall 6 months within the 10 year cut-off period. Any views on that?

This rule was changed in Feb 2018 where now you need a PCC only from a country where you have stayed for more than 6 months in a row in last 10 years. Due to this new rule only, you don't need US and Aussie PCC too.

Thank you Maverick!
I found the following paragraph on the CIC website link: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/apply-permanent-residence.html#police

"To immigrate to Canada, you and any family members who are 18 years old or older must include your police certificates as part of the application for permanent residence. You need one for every country, other than Canada, where you stayed for more than 6 months in a row in the last 10 years since you were 18 years old."

I guess you're talking about this rule?

Thank you Maverick for your explanation on Police certificate.

Kindly guide me on this question if you have an idea. I collected my police certificate in Saudi Arabia one year ago but about submitting now. Difficult to get a new PCC. However, there is no validity period written on the PCC. Can I go ahead and submit the PCC I have with letter of explanation?

Thanks.

Hi,

I am in the same situation as you. Just wanted to know if you have received your PR or have they asked you for a police clearance for the time you spent in Kuwait? Thank you

Hi, I am still expecting Maverick view on that.

I want to submit my PCC for ITA received. PCC is a year now and cannot get new PCC. What to do is what I asked if I can submit the PCC with letter of explanation. Thank you.

As far as I know, foreign country PCCs can always be submitted even if they're expired. The case officer may ask for a new PCC. Please look at the paragraph below through the link.

https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/apply-permanent-residence/police-certificates.html

"Date the certificate was issued
For the country where you currently live:
this police certificate must have been issued no more than 6 months before the date you submit your application.

For any other country from which you need a police certificate: the police certificate must have been issued after the last time you stayed in the country for 6 months or more in a row.

If you have a police certificate that is now expired, include it. We’ll accept it, but an officer may ask for a new one later on.

If you’ve requested police certificates in the past, you can also include copies of the originals in your application."
