Hello All,

I need your honest suggestion regarding my case. I am a Canadian Permanent Resident and currently doing a full time job in Canada. I am getting married by September, 2015 (Still got three weeks time). I am going to India one week prior to my marriage and staying in India for three weeks after marriage. I am planning to apply for TRV for my Fiance (Spouse by then) within two days after my marriage with marriage certificate and photos. My Fiance just finished her college education and never travelled outside India. She applied and got her passport only 5 months back. She is unemployed for now. I am going to show property worth around 1 crore and 6 lacs bank balance in her account. Also I am going to sponsor for her one month stay in Canada. I have ticket iternary (both to and fro ticket) ready for her (along i am going to show whole trip details).

My questions:

1) What are her chances of getting visiting Visa for Canada with above situation?

2) If I apply after marriage date, is it possible to get visa within three weeks of time so that I can take her along with me?

3) Do you suggest to apply visitor visa on her own instead of going through spousal sponsorship?

4) Which is best? Applying through paper or online?

5) I am going to show below documents, Please let me know if I need to add any more documents. Please suggest.

> Documents that myself as a sponsor will submit:

> Invitation letter,
> employment letter,
> Notice of assessments for last two /three years (you can get this by calling CRA)
> copy of T4 form for 2013 & 2014 year,
> Bank balance statement (CAD 18,000)
> three/six months bank statements
> Three months' pay stubs
> copy of PR card,
> copy of passport (all papers that have any stamp/ information)
> copy of driver's license/ copy of lease agreement form (for address proof)
> copy of register marriage certificate

> Documents that my wife will submit:

> Letter to embassy
> Application forms
> two/three passport size photos( i believe its two)
> bank balance statement
> bank statements for last 6 months
> form 16 for last two years
> CA report for properties ( properties, LIC documents, fixed deposits etc.,) (make sure to submit copy of originals)
> original passport sent with application
> flight ticket (two way ticket)

Thanks in Advance.

Hi,

1) What are her chances of getting visiting Visa for Canada with above situation?
The chances of getting a TRV with a spouse living in Canada are low as the visa officer may believe the visiting spouse will overstay his/her visit..... despite this it is possible for people to get TRVs after getting married.

2) If I apply after marriage date, is it possible to get visa within three weeks of time so that I can take her along with me?
Processing time varies.... some applicants have got decisions in a couple of days whereas there are several applicants who are waiting for decisions even after 1-1.5 months (calendar)..... and the latter category are general visitors (not spouse visitors).

Do you suggest to apply visitor visa on her own instead of going through spousal sponsorship?
By spousal sponsorship did you mean PR spousal sponsorship? Or inviting your spouse for a TRV?

Even if she applies for a TRV on her own, she must declare that she is married to you and intends to visit you. You will provide an Invitation Letter and supporting documents as her host.... so CIC will consider her marital status/spouse in Canada when they assess her TRV application.

4) Which is best? Applying through paper or online?
This is really a matter of personal preference.

5) I am going to show below documents, Please let me know if I need to add any more documents. Please suggest.
Your documents as host look perfect.

For your fiancee/spouse documents:
1. Does she own the property? Fixed Deposits? LIC?

2. Along with the CA report, you must also submit copies of the Sale Agreement + FD receipts + FD Interest Certificates (to show interest is credited to her bank accounts), etc

3. Also do submit supporting documents such as newspaper clippings from Property Times/prints from realty portals like MagicBricks, 99acres.com etc to prove the market value is approx. the same as valued by the CA.

4. None of the money in her bank accounts must be recently transferred (do prepare an explanation if it is transferred between her bank accounts)..... and must not be borrowed from someone.

5. Has she filed her Income Tax Returns or does she only have Form 16?

6. If your fiancee/spouse is employed or a student when she applies then this will make her case stronger

Cheers :)

Thanks bryanna!! Keep up the good work of answering all our queries...

Yes trv with sponsal sponsorship. What if I apply visitor visa for her before the date of marriage and show myself as friend sponsoring for her trip expenses? What do you suggest?

Fingers crossed. Hoping for the best. :D

I would not even try lying to CIC or not disclosing a forthcoming wedding :)

Another suggestion:
You could apply for her PR after your marriage.... let the PR processing cross Stage 1 (sponsor approval) and then apply for her TRV. This seems to have worked for some of the other applicants (of course, your spouse must still prove her strong ties to India)

Cheers :)

Nothing stopping you from doing that. He has to qualify for the TRV first...if he has a good job, travel history, and lots of savings.

No his name is not in my p r application. But if he apply for visitor, he has to let the cic know about our engagement. So m worried if he will be able to get visa if he tell them that his fiance is in canada.

You are right to worry about *HIS* TRV because of this reason. That's why I said he has to have a good job, travel history, and savings to get a TRV. This is the case whether he has a fiancée in Canada or not. But YOUR PR application will NOT be affected in any way.

Should i invite him? I mean what would be the best reason of visiting? We want to get married wen he arrives canada and add up his name in my p r application.

Let's just say that TRVs are meant for short term visits and are approved by proving ties to the home country. You're not mentioning if he has any of these ties, so I assume that he doesn't. While there have been other applicants who have been approved for a TRV with the similar situation as yours (declaring that they want to get married in Canada), it's not very common.
You have to do your research, exercise your best judgment, and make backup plans in case his TRV isn't granted.
