Hi Everyone,

Needed some clarification on a particular situation. I'm sure it's been asked somewhere here but I'd rather get an opinion or facts from some of the members on the forum.

Me (a Canadian Permanent Resident), getting married to an Indian resident (not a Canadian PR/Citizen) sometime in the future. I've looked at the spousal visa route (family sponsorship) and it seems like it's going to take a lot of time before we can actually be together in Canada given the timelines of the process involved (12 months currently as per the site after a complete application has been submitted).

On the other hand, I think she has enough qualifications/credentials where I feel that she can get a PR on her own if she applies as a SINGLE applicant today or very soon via the Express Entry route since we plan on getting married sometime next year. Let's assume also she gets the PR as a final result.

Question: Does she have to complete her landing procedures as a SINGLE applicant only in Canada because she applied as a SINGLE applicant (meaning we push out our marriage date since she needs to do this first and land) ? Can she update IRCC about her marital status while her application is being processed or has been processed to let them know she is now MARRIED and is no longer SINGLE and then complete landing procedures in Canada? I feel there is no need for her to update me as a SPOUSE on her application in case the application is still being processed by IRCC since I already have a PR. Or maybe she has to inform IRCC about her change in marital status but not include me before she lands?

What's the best way to go about this situation to avoid the most hassles? I'm trying to get her to avoid a trip to Canada just to complete her landing procedures as a SINGLE applicant first and then having to travel back to the home country for the wedding. Once she gets the COPR/Passport stamped, what's the best way for her to complete landing formalities? Basically, what's the best way for her to update her marital status and then complete landing with her status changed from SINGLE to MARRIED. Appreciate if some members could provide valuable feedback. Also let me know if some things aren't clear. Thanks.

I am no expert so please double check.

- she can apply as single. She can land without disclosing because in this case her spouse (you) don't need visa and so there is no need to mention. Once she is in Canada you can register your marriage if needed. Maybe while registration you need to provide marriage date, not sure if that will have some affect.

Thanks @chikoo1985, but I still feel letting IRCC know that her marital status has changed before she lands would be the better thing to do. Still don't know how to go about doing this though? Any other suggestions ?

I've looked around the forum for similar topics and questions asked by other members and it seems the unanimous decision is to always let the VO know that you're marital status has changed prior to completing landing. We plan to do that after the marriage of course. What's not clear to me is how an applicant can not include the spouse on the PR application. Since I'm already a PR, there is no reason for my wife to include me in the application, but how is that actually done ? Can someone maybe send me the details of the particular application (a link maybe) or explain what is the process of not including the spouse on the PR application ? In other words, inform the VO, the marital status has changed but not include the spouse. I wouldn't need her to sponsor me anytime since I'm a PR already. Thanks.

I think what you said is true and it's better to inform the officials about the change in the status. let her start the application as single right now and she can always inform/update the marital status once she is married to you. I think this won't change anything. People do it all the time. It's just once has to inform CIC once their status changes. If I come across links will share.

Completely different thought came in to my mind. Before her PR process begins why don't you or she apply for her vistor's visa while she is still single. Then she can start he PR process and follow the guidelines. So at least she can visit canada on visitor visa and let PR process take it's time.
