H&C Humanitarian Ground with/or Without Failed refugee claim

I will start,

I applied for H&C last year on january by my own on best interest of a child ground.
7month later, without any AOR, I got a call from CIC to update my file and we talk for about 30mns about my application and familly. I receive AIP (Approval in principle) 1 day later.

Since the AIP I didn't ear any news from IRCC until january 2018, I received médical request and Annex A request. it's was all done by the end of january and my background still in progress.

and I still waiting....

Hi.. I am also planning to apply on best interest of a child ground. Are you a refugee before you applied? How did you stay in canada while waiting for the result? Are you on work permit? Thanks

Yes I Can,

First time, it was a missed call from unknow number, and she leave a voicemail with number to call back. but before I even call her back, she call me again. she was really nice and asked if I can talk a bit about my case.

She wanted to know if I already gave birth, if I had a new partner, if I did my tax declaration, If I had a job, If I'm on welfare, then she gave me a fax number and ask me to send proof about my baby birth and tax declaration.

After that she explained that my application decision gonna be made by her, and if she approuved she will transfert the file to another officer for the stage 2, but if she declined my application will end right there with no right to appeal. I asked if I can do something to increase my chances, and she reply that honestly being on welfare ( because of newborn at this time ) can result to a refusal at the stage 2, even if she approuve stage 1, so she advise to find a job as soon as possible and send her job offer letter, she gave me 3 month to do so.

I was septical about that, but 4 days later, I receive a AIP letter by post canada, and notice that she made her decision one day later her call.

3 weeks later, I send my job offer to her with a letter of thanks.

normally h & c approval are low does not matter if you have a child or no child you need a good story

Yes I know its just one of the factors to consider. But its one of the exceptions not to wait for the 1 year bar after your refugee claim was just denied. Thanks

i dunno so many refugees with faIL case try to use h&c route and still get denied I do not get it and it seems like a popular route

Sorry for late reply, I'm living in Canada for 10 years now and I applied my refugee claim Two years and half ago with a lawyer but it's failed. But before the refusal I asked for a work permit and I got it for 1 year then for 2 years. Meanwhile I worked on my HC case for almost a year to make sure my story is well explained with all the prouf to support my case before applying. It's took much Time but it worth it. It took 6 month for AIP and a year for medical request. I still working with my second work permit.

Before my refugee claim I was no statut for 3 years. I live in Quebec. And my kids borned here as well, in my gcms notes I saw that IO took my kids wellbeing in count to made her decision. On the interest of child No need to wait for the one year bar.

Thanks for the reply. Yes, i am a refugee claimant but my hearing was denied. Im still waiting for the decision letter in the mail then appeal within 15 days. Im also thinking of applying for h&c at the same time but my lawyer said to take things slow. We will try to appeal first. Been here in canada for almost 11 years now. My daughter was born here in 2015. Did you prepare yourself all the things you need for the h&c? Cos i dont want spending too much for my lawyer. Would you mind sharing it to me pls? Like what to prepare or to submit to make a strong case and story. Did u had an appeal also? How were you able to get a work permit if you’re out of status? Thank you so much. Would appreciate any help.

Once you claim refugee you can get work permit! The first on took 3 months to process then 3 weeks for futurs ones! I did all by myself! Because I didn't have good lawyer nor money, I prefered keep the money for HC fees. I will help you as much as I can! I appealed but got denied i even filed prra while hoping it to succed and to keep the removal order on stand-by in case it failed.

Oh ok. So did u apply h&c while your appeals were on process or after your appeals failed? Cos even if you have a valid work permit if all your appeals were failed then you will still be deported cos you dont have status anymore even if you applied for h&c. They said they can send you back home while the h&c is on process. Pls enlighten me. Is the h&c fee expensive? Thanks again.

H&C cost 1040$ in total, I applied H&C after appeal failed (I wait to long) because my situation was so bad and I did have the money yet. But after appeal denial I still had right to prra, so I did my H&C application then prra few months later. Yes they can send you back while H&C are processing, but once you filed prra they have to wait prra responce before attempting to remove. And H&C and PRRA are processing in the same place, so I was hopping that IO will combine my two case and make the decision for both. By God grace it's what happened.
I received my AIP and few days later a letter that my PRRA are closed and removal order suspended.
