Can I apply as conjugal partner?

Hi everyone,

I am very confused at the moment. I want to immigrate to Canada soonest to be with my boyfriend of 4 years. He was sponsored by his mother and became a Permanent Resident in Canada. However, he tried finishing his studies here in the Philippines so he extended his stay, then after taking the board exams here, he immediately went to Canada to be with his family. We wanted to see each other, but he can't come here because his PR card is expiring soon and he has not yet completed the required days of stay in Canada. So as of now, he cannot come to the Philippines, he will try to come after he renewed his PR which is in 2019. I tried applying for visitor's visa last November 2017, but was denied. Now we cannot be together. Can we apply as a conjugal partners? He is willing to sponsor me and willing to do anything for us to be together.

There is no obvious immigration barrier to him coming to be with you, apart from his own PR card issues. Also, if he is not in compliance with the residency obligation requirements, he can't sponsor you anyway.

Conjugal partner appears not to be an option. An application at this time, based on "conjugal" would almost certainly be doomed.

Just to cover all of the possibilities, did any of these things happen?

1) Did you live together at any time before he landed as a PR? If so, for how long?
2) Did you live together at any time after he landed as a PR? If so, for how long?

Just want to clarify whether this is a heterosexual or same sex couple? Do agree that the fact that he isn't in compliance with his RO is his fault not an immigration barrier. Until he is in compliance you wouldn't be able to be sponsored as previously indicated.

No you can't be sponsored at this time.

If he even attempted to sponsor you under any type of app, that would make IRCC aware he doesn't meet Residency Obligation and they would revoke his PR status.

So once he is back in compliance with RO, he can then travel to Philippines to marry you, return back to Canada, then sponsor you as a spouse.

Unfortunately since he can't travel outside Canada while in violation of RO, and you can't get a TRV to Canada, it will be quite some time before you can see each other again.
