Parents Sponsorship LICO Doubt

Hi,

Following are the income for a person looking to sponsor his parents


2015 - $51000 (currently single)
2016 - $75,045 (got married, spousal income added)
2017 -$78711

Now if the person wants to sponsor the parents, the family size will be 2+ 2= 4

both income of 2016 and 2017 are above 4 family size. However, 2015 is below for 4 family size but above for family size 3. As that person was not married in 2015, technically family size was also 3 in 2015.

Thus, does that person needs to wait for 1 more year or can file it ?

Only family size that matters is at time you submit application. This is the family size you need to meet for 3 consecutive years. IRCC wants to see consecutive stable income to meet your current situation.

I think Rob_TO is right and this is a stupid rule as your case shows the injustice.
Why is it injustice? Family size in previous years is not relevant to your situation today. The whole point of using 3 consecutive years income, is to show stability and that you are capable to provide financially for your current family situation.

Well it is a matter of perspective. There is no perfect system. There are others who have incomes for 2015, 2016 and 2017 in excess of $300,000 but cannot win the lottery. Stupid rule? I say fair system.

thank you for the reply. Can the spouse show income of 2015 to fulfill the family size 4 income requirements even though they were married in 2016 ?

It's injustice if they don't allow him to use his wife's income from 2015 (when they were not married). Overall the system is discriminating for parents and grand parents. Nothing more important than having your parents beside you.

$50k is a fair income for a single person. He has been married for two years. You can NOT say he is not stable. + Parents should bring more stability. It's a vicious cycle - hence, injustice.

Yes, the co-signer can use their 3 previous years income, regardless if they were married at that time.

He can use the spouses's income, as long as they are married at time app is submitted that's all that matters.

Of course it's discriminatory, it has to be. It discriminates based on health of the parents, and on income of the sponsor, all to protect Canadians. It also discriminates against brothers and sisters who can't be sponsored but some feel are just as important as parents. Unfortunately some sponsors and parents will not qualify, and for those that do there needs to be some way to control intake of parents per year.

The word discrimination makes it sound so unfair.
I would say it's "selective" or something to that effect.

"Discrimination" means it would be unjust or for no good reason, but the rules are in place for justifiable reasons.

Yes I would avoid using the word discriminatory. Maybe saying "consideration" would be more appropriate.

. you are wrong in counting the family size . Below is how you do it . Staright from VO. spread the right word.
Joseph and Anne became common-law partners in 2017. They had a baby in 2018. Joseph wants to sponsor his grandmother and grandfather. Joseph’s grandparents don’t have any dependent children. Anne will be the co-signer.

If Joseph wants to sponsor his grandparents in 2019, Joseph and Anne (together) have to meet the income requirements for 2018, 2017 and 2016.

In 2016, Joseph’s family size was 3:

  • Joseph
  • his grandmother and grandfather
In 2017, Joseph’s family size was 4:

  • Joseph
  • his grandmother and grandfather
  • his partner, Anne
In 2018, Joseph’s family size was 5:

  • Joseph
  • his grandmother and grandfather
  • his partner, Anne
  • his baby
Even though Anne is only included in the family size in 2017, she has to provide her proof of income for 2018, 2017 and 2016, as she’s the co-signer on the application.
