Common-law with a pending criminal case

Good morning, I am an Express Entry nominee, however, it was just lately that we knew that my partner's criminal case is still pending. He was one of the accused for grave coercion and I believe it is equivalent to a hybrid offense here in Canada.

I applied for a common-law status but now I am thinking of not including him yet while he arrange the case and be cleared.

I just don't want to delay our chance for being approved as a PR particularly for my son. It is really hard for me as a mom to be away with him and cannot take it that a mere accusation on my partner will ruin our dreams of a better living.

Generally if a family member of an applicant has some sort of inadmissibility, it would affect the entire application and no one from the family would be able to immigrate until it is remedied (if possible). I am not sure how things work in case of common law partners where there is no legal binding (like marriage) between two people. You might need to check with an attorney to see if it would be possible to exclude him from your application while mentioning the fact that you have a kid from the relationship.

You could only remove your partner from your app if the relationship actually ended. You cannot stay in the relationship but remove him from the app so that it is approved. That is immigration fraud. It would also result in you never being able to sponsor your partner.
