Add spouse on protected person application

Good Evening,

I am protected person waiting for my permanent residency, recently I got married and my husband who came to Canada on study permit didn't get the approval of his work permit application two years ago. so now he has no status in Canada.

My question is can I still add-on him in my application or do I have to wait to get my permanent application. I am so confused I don't want my husband to get stuck in any immigration problem.

Please advice.

It doesn't matter you like or not to add on your husband to your own PR application, you have to report to CIC your marital status change and update your application to include your husband, either as an accompany (will get PR with you, if your PR is approved) or non-accompany family member(will not get PR with you, but later you can sponsor him). Otherwise, you will find yourself in a big trouble that you will be charged with misrepresentation, and your husband will be excluded from your family member forever.

The downside of adding your husband to your application is that 1. it could delay your application process. 2. Since your husband is out of status, you need to prepare a lot more additional evidences to prove that your relationship is genuine and your marriage is not a desperate move for your husband to get PR (marriage of convenience). CIC definitely will take a very close look at your case. Also, your husband may find that CBSA will issue him a removal order that he has to leave Canada first till your application approval.

Definitely agreed. His circumstances make his situation look like immigration of convienience.

hello, I am a protected person in Canada, and I have a wife she is living here in Canada but she is on a student visa. I haven’t still applied for my PR so I was gone add her on my PR application, is that a good idea? The other thing is after we submit our application can she apply for a work permit and take a break from school? Any suggestions helps please, thank you

Good day everyone, I really need help here from those who have applied for spouse before. I am a protected person and have applied for PR since December 2019. I just got married three months ago and want to add my spouse. I filled my spouse generic and background form as.....
Program under which you are applying for: FAMILY.
Category under which you are applying for: SPOUSE but my lawyer is saying that the program should be REFUGEE and Category should be...................... 'IN CANADA- PROTECTED PERSON. This has got me confused and i have not been able to send it to IRCC. Can somebody who have gone through this process please tell me what is right please so that i can submit it ASAP. Thanks waiting for response.
