Hello.

Can someone please share advise on this:
We applied for temporary resident visa for parents in Delhi. All genuine document submitted however their visa is rejected due to following reason:
“Application does not meet the requirements of IRPA and IRPR. I am refusing your application on following grounds:”
“I am not satisfied that you have truthfully answered all questions in the documents you have submitted in support of your application, as required by subsection 16(1) of the IRPA. Specifically I am not satisfied that the following information is truthful: you have not properly answered question 2(b) on your application form”

Please suggest! FYI - they had gotten rejection on their US visa last year, however it was declared in the application. Should we clarify and justify why the us visa application was rejected?

Given that statement, I would order the GCMS notes before applying again to find out exactly what the VO concern is. IMO, your parents were lucky just to end up with a rejection and not a 5year ban for misrepresentation. You will need to specifically address the information they have deemed to be “questionable”. If you don’t do that and reapply with the same information they may find themselves facing a ban next time.

Agreed. 100%.

OP:
Did a travel agent/ immigration consultant apply on behalf of your parents?

Under which section of the US law were your parents refused?

Thank you Buletruck: Just to clarify - is this what you mean by ordering GCMS notes? if yes - we are PR holders in Canada - so we can order GCMS notes for parents right? Would appreciate if you could confirm on this as well. Once again - Thanks for your prompt response. I am looking at following notes on how to order GCMS notes

Yes - Travel agent had applied on behalf of my parents in India.

For US visa refusal: They didn't get exact reason. However, there was a language concern for them during interview. They had requested for interview in hindi, however were still asked questions in english and to which they were not able to respond and got nervous. This is why we think their visa was refused. Any thoughts?

Do your parents have a copy of the TRV application forms which the travel agent had submitted?

That's right. They wouldn't know the exact refusal reasons for US visas.

That being said, your parents would have been told that they were refused under a particular section of the law. For example, 221(g) of the INA (i.e. for inadequate documentation)..... or, 214(b) (i.e. for not being eligible for a particular visa category) )..... or 212(a)(6)(C)(i) (i.e. for misrepresentation), etc etc
