hello everyone, so my story is...im 18 years old and my family applied for refugee in Canada back in 2011. On july 2017 it was refused and we had a deforal removal from Canada. Then on September 18...only 2 months later the stage 1 of h&c was approved in just 9 months. Its been around 4-5 months since stage one was approved. So far only schedule A’s have been asked which was like a month ago. My question is how long will it take until we can return back to Canada for the PR ?? I know it varies for each case but does anyone have a general idea ? How long is the average time process for background checks and medical checks for outland ? Just to put it out there the MP of mississauga is in contact with immigration as well as our lawyer is for our case is that gonna be any help ? I am a little worried that for some reason something Bad will happen...but no one in my family has a criminal record of what so ever and we are all healthy but im still scared because its taking soo longggg....like i want to go back to Canada so my brother and i can continue our education and we can finally start our lives.... any help will be greatly appreciated

When was the H&C application submitted? H&C applications typically take 2-3 years to process.
 
In that case you probably have another year or so to wait.

Btw i just recieved an email from immigration asking my family to “show proof of our current residence so they can take appreciate steps with the processing” is this normal ?

It's based on the processing times posted online by CIC (see post above) and also experiences of those on the forum who have applied. It's a process that takes a few years - not a few months.

I understand... i just dont get it. We got stage 1 approved, stage 2 can be done alot faster. Now i am outside of Canada and i cant study here and barely can find a job so this is painfull... wasting all the money we had saved in Canada and just waiting until the day comes to go back to canada

There are a number of answers to your question. Background and security checks take time to complete. Typically a few months - but sometimes much longer. H&C is also an exception stream for individuals who don't qualify / can't apply through a regular immigration stream. It's not processed with the same priority of certain other streams (like Family Class, for example, which is processed as a priority stream).

At this point is processed like any other PR application. Background checks, security, medical.....the whole process. You’ll just have to be patient (I understand that is easier said than done) while the background checks are done.

I see... thank you makes sense. Is there a way for an application to be refused if you haven’t missed the 30 days or if you do not have any criminal records ? And is there a way for my brother and I to do a student visa to Canada while this application is in progress ?

There's always a chance of refusal until the end.

You should assume a study permit will be refused given your failed refugee claim and deportation. It will be a waste of money to apply.
 
You still have to meet all the eligibility criteria for a PR application. So, there is the possibility it could be refused, but based on what you have posted, that is probably not an issue.
I don’t see why you couldn’t apply for a student visa, but personally the chances of it being approved are zero. The deportation would be a huge negative factor and most likely result in a rejection.

This is gonna be a painful process... ill keep you guys updated. Right now they are asking my family for proof of residence so they can take the appropriate steps to take in the process of this case ? What does that mean ?

I don't know. We typically recommend people work with a lawyer if they are going to do H&C.

Also, people are typically in Canada for H&C applications. I don't know how it works once you are outside of Canada.
