Urgent help - inland spousal sponsorship application returned

My husband and I submitted the spousal sponsorship application (inland) in late December 2017 and my student permit was valid until December 30, 2017. I’m applying also for PR and Open Work Permit. Our application had been returned today because we were missing one document, so we are planning on submitting the application again. However, is it possible to submit the exact same application again + that missing document? I mean, we won’t change dates, will it be a problem? If I change a date, there is one section asking about my current status and country of residence (from-to) and if I change date for today, it won’t be true that I’m still a student because my visa expired in December. Moreover, do I still have an implied status?

Can someone help me please what to do?

Be sure to check to see if there is a new OWP form. If so, use that instead. I think you may be out of status now that your student permit has expired. Consider calling CIC tomorrow to get their input.

You don't have implied status. The application was returned as incomplete. You will need to update the forms to reflect your current status, as this is effectively a new application. You probably need to apply for restoration of status as a visitor.

This is not the news you want to hear, but you are now out of status and need to apply for a restoration of status. You must be in status to apply for the OWP, so you need to wait until you hear back on the restoration before you submit your OWP application. You can re-apply for PR right away however.

And in regards to the forms.. You will have dated the signatures in your pr application package in December. I personally would not risk sending the app back with those signature dates. Whilst not "out of date" they will be over 2 months old. And you MUST update the form to inform CIC that your status is no longer as a student. You are out of status.

Not that it's much help but what you should have done was submitted a visitor application before your status (as a student) ran out. You would then have been covered in the rarish eventuality, that your app was returned. Unfortunately you were one of the unlucky ones.

As someone who has been out status (different circumstance to you) I can say the application to restore isn't dfficult to complete..it's just a pain that it has to be done..and will cost you $200 for the pleasure.

Good news is that your restoration is very likely to be approved as the reason you are OOS is just a misfortunate technicality.

Honestly I can’t remember I did inland from 2015 it wasn’t untill late 2015 that my application went through and wasn’t returned. We paid all our fees upfront except for the right of permanent residence fee.

Hi why were your husband out of status? I'm in the same situation now and my restoration has been turned down in late July too. I was told there is nothing I can do about it as I also have difficulty leaving the country due to the pandemic. What should I expect? Thank you.
