Non-Accompanying Dependent Child

Our inland spousal application was sent December 18, 2017.
Got out AOR February 05, 2018.

I was sponsored by my husband who is a Canadian Citizen. I have a dependent child with my past relationship and he was included on our application as my dependent child, accidentally we put him in non-accompanying dependent child but that is not what we want to happen. We want him here. We made a mistake for not understanding what non accompanying means. We just thought that since he was not here in Canada he can't accompany me right away. Is there a way of changing him from non-accompanying to accompanying dependent child? Would it slow down my whole pr process? What's the best way to do now? Thankyou so much for the help.

I think there are two ways that you can do it. One is to withdraw your application and reapply with an explanation letter to explain why the application was withdrew. Second is to file a specific inquiry via webform to inform the CIC that you want to update the form, then you upload the updated form with an explanation letter to explain the situation. Both ways will definitely delay your application process.

I'm watching this thread because I'm curious. If you are able to get your child switched from non-accompanying to accompanying I'm wondering if a dependent can be outside Canada on an inland application (even though the principal application is in Canada).

If the child gets switched to accompanying, do you have IMM5604 ready and the custody agreement should show that the child has permission to move to Canada. My wife needed to go Family Court to get the form signed and to amend the custody agreement because the father refused. My wife doesn't have sole legal custody. We did an Outland application because of the necessary travel of my stepson to visit his father.

If we just do the inquiry via web form, would it also affect the open work permit process?

As far as I know, a dependent child can be outside Canada on an Inland Spousal Application.

I don't have any problem with my child's father, for I have the full custody of the child since birth. And he doesn't give any financial support to the child from the very start. He will be so selfish if he will refuse to sign it. I already call him about this matter and he said he is willing to sign.

Probably not, because OPW is processed independently from your spousal application.

If we just think of it carefully, we wont commit a mistake like this. I just hope it wont make the whole process real slow for we were going to correct it just from almost the beggining of the process.

It won't be very slow, although nobody is for sure how the CIC handles situation like this. It may take days for them to swap out the forms or it may take weeks for them to swap out the forms. And after you upload your updated form, please follow up with them to make sure that they do swap out the form, because CIC do earn themselves a bad name of not taking care of the applicants.

We actually hire an immigration lawyer for our whole application process but they seems so unhelpful to us. Before they get paid we often receive calls to them but now they doesn't even answer email. That's why were getting so frustrated and finding ways by our own. We call them regarding this matter, they actually dont explain to us about that non-accompanying/accompanying stuffs before thats why we doesn't know that my son can also come here as dependent under my application. So we call them that we want this change and they said they can't do anything until we got my AOR, So now we already have our AOR, And thanks God still don't hear anything from them. :(

That's why were getting so frustrated and finding ways by our own. Ya, some lawyers are bad apples. My lawyer was actually really responsive. Anyway, since you have a lawyer to represent you, he/she has to file for you. Don't be shy, keep bugging your lawyer.

Absolutely no need to withdraw. A simple webform to change the child to accompanying is all that is needed and it will not delay the app.

Only the PA is actually required to be in Canada in an inland app. Dependents can be anywhere.

Yes thanks for the help.
We just hope they are really looking after this whole process, we're scared that they're not paying attention on requests and emails update coming from cic. For we have no access on the account and they are the one who have access on it. All we have to do is to wait for them to contact us for update.

Do u know if my son will be needing a passport right away to be added as accompanying? For he is still on process of obtaining a passport.
