It seems like trips and visits are way more important than the chat logs because it showed that money and time that you two spent together. I could be wrong but I kind of suspected that there might be some points system that they used at the appeal that some evidence are weighted more than the others.

For example having a kid with your spouse will almost guarantee you a pass. But if you don't have kids together, then your trips and visits might be your best bet to win your appeal.
I been there about 9 times in total. Stayed as long as 6 mos after marriage. Every time I would stay about a month to 1.5 or 3 mos.
I am 16 yrs older, but you can't just say age is just a number. You have to have had serious talks. Do you want kids, what happens if your wife can't have kids. We try with medical help, if not we can adopt.
Just for example.
I would have preferred a family member or close friend come to our wedding for instance. But expensive, my mom don't like flying. Answer to every reason for refusal.

Hello everyone, as probably most people in this forum I'm trying to find some answers...

I entered in Canada on June 15, 2016, and was issued an OWP valid until June 14, 2017 (working holidays program). My partner is Canadian, we've been together since Sept 2014, we live in the same apartment (rental contract under both names) since July 3, 2016, I sent CIC photos and everything to prove that this is a genuine relationship, we also officialized it signing a common law agreement to make the application more complete.

June 15, 2016:
arrived in Canada and was issued an OWP valid for one year;
May 13, 2017: I submitted my paper application for Spouse Sponsorship
June 27, 2017: CIC returned my application due to a missing translation
July 25, 2017: CIC received all the paperwork again
September 12, 2017: they requested my Criminal Checks, which I uploaded online a few days after. And haven't heard from them since.

My concerns are when I first sent my application my OWP was still valid, by the time I resent it wasn't. However, when they received my application for the second time my visa was expired for less than 90 days, so I could have my status restored. ~I haven't paid for the restoration of status since I wasn't aware of it at the time :/

I don't even know what my status is, my eTA is valid until 2021.

Today is February 5, 2018, I haven't heard from CIC since Sep 12, 17. My concern is if is there any possibility of CIC extending my work visa or for me to work again will need to wait for my PR to be issued after 12 months of wait? Does anyone face the same situation with your applications not moving forward for months and months?

I really wanted to go back to work, even more knowing that I am a skilled professional and could find a good job easily, keep paying taxes and etc...

Any help and advice would be really appreciated!

Idk anything about the work permit extension. But you submitted your spousal sponsorship too soon. You were not living together 12 mos. You submitted in May, when you should have sent it in after July 3, 2017. But now they have received all paperwork again in July. Should be OK. Have you linked acct or gone on ecas to see more info?

Hi SV670, I know your appeal is in Toronto and you won your appeal without having counsel, did IAD ask you to attend a silent court to walk you through the process a few months before your hearing, thanks?
Hi, I was not asked to go through any hearing process, before my own hearing.

Hi my husband is a Canadian citizen . Actually first nation Canadian.We met in 2013 and we got married in 2015. I had a warrant out because I filed for refugee and didn't attend the hearing so my case was considered abandoned. We got married in Jan 29 2015 and I was arrested by immigration 3 months later in May. we sent our application for spousal sponsorship in Dec 2015 and I was denied in September 2016. The visa officer got my marriage date wrong and she used that as the basis to deny me. she said in her refusal letter that we got married in the summer of 2014 which was wrong since we got married in January of 2015. I think that those immigration officer play with people's lives and do whatever they have to do to refuse ur application. My husband and I didn't appeal since we didn't want to to take the chance. If u appeal and I lost then ur spouse can't ever sponsor you. So we reapplyed. now I am waiting.

Well, if it was that simple, it doesn't make any sense that you didn't appeal, it should be a easy win, shouldn't it? The refusal definitely was not solely based on the date of your marriage, the refusal must bare much more serious considerations regarding your case. And btw, whoever told you that once you lost your appeal, you couldn't sponsor your spouse ever, is definitely wrong.

While it is so easy to point fingers to blame others for things didn't go to your way, why don't you just look at yourself for that? You played the system at the very beginning, and it just simply came back and bit you. And I may sound harsh, but I just stated the facts.

Wish you the luck for your reapply, because you do need it.

Was your application inland or outland sponsorship

Also FYI, if you appeal and get ADR and lose then you can go for a full hearing and if that also you lose then you can go to federal court for judicial review. If you lose I federal court you cannot reapply to sponsor the same person ever.
I agree with her that they do refuse applications for silly reasons without considering the facts that's why so many people appeal and win. If they did their job properly then they wouldn't refuse in the first place and delay spousal reunification.

To the poster that I commented, Yes, she played the system first by claiming the refugee and yet didn't want to attend the hearing, and while she supposed to leave the country, she voluntarily decided to break the law and stayed illegally. She didn't respect the Law and now it came back and bit her, isn't it a fact?

And btw, whoever told you that you cannot reapply after your appeal lost, is completely wrong, unless you lost the appeal on the ground of IRCC 177 (9) (d)

If you don't have anything nice to say or any beneficial advice to a person who is just expressing their situation in this forum, then don't say anything at all. People are not coming to this forum to listen to criticism, they are coming for support and advice.
We don't know the facts. She never said that she didn't want to attend the hearing or that she stayed in the country illegally. How can you make these assumptions?
Please check about the rules after losing in the federal court.

Is this system 100% bullet proof or perfect, it is not. While there were definitely cases wrongfully decided, but most cases were denied with a valid reason or reasons. It is so easy to point a finger to others, such as my lawyer didn't do a good job, VOs didn't review all my evidences or the system failed me, did anyone really thought about from their end? Did anyone ask themselves what if I took time to collect more meaningful evidences and prepare my application more thoughtfully to come over my short comes, instead just rushed in and did a sloppy job? Did anyone really introspect themselves and to know why was the real reason(s) that caught them in this limbo situation, and not just kept saying things like I forgot include my wife and/or children in my PR application, I forgot that I was denied VISA from other countries?

And Yes, you are right that we didn't know the whole picture, and people intended like to play victims in a situation like this, all we can do is to either support or criticism them based on the info they publicly posted here. I can sing my pray all day long here, but it won't help anyone even a bit or benefit no one, worse yet, sometimes will provide people unrealistic hopes and harm them more.

You didn't see the benefit out of my criticism, is because you were in this and cannot see clearly as an outsider can. While my criticism is not necessary to benefit the poster, but it definitely deliver a righteous message to whoever will come through this thread to try to get useful info, and that is action comes with consequences.

My application was outland.
Ok...just wondering because if it was inland you are right if you are denied you have little to no rights of appeal.

Outland you can appeal ...if you don't win you can go to federal court ...and your sponsor can still try again after that to sponsor you .


As long as conditions or evidence has changed for the reason you are refused

Hi, I was not asked to go through any hearing process, before my own hearing.
I had thought about attending someone else's appeal but after doing my own. I would have not welcomed anybody else in the boardroom we were in.

In a case like that sometimes immigration can ask you to leave and reapplied out the country doing a refugee case leave it is a serious matter you will have to give them a explanation why you apply for refugee and leave second the immigration is going to look at you like you can't be trusted you third you rather live here illegal and that is a criminal offence I didn't even know staying in Canada without status is a criminal offence until I with to the detection center and I was reading a post on there wall and it state staying in Canada without papers is a criminal offence you lucky they didn't detent from what I know and people who went through that situation immigration ask them to leave and tell the spouse to file a outland but maybe you might be lucky to stay pray cause only God can turn around a situation that seem there noway out I can tell you have a lot of explanation

You have to get the police record from all of the three countries if you stay there more then 6months
