Adding my bf in my PR application

Hi guys,
I got my provincial nominee in June 2017. In Sept. 2017 me and my bf moved in together, in the same month, I mailed out my PR application to CIC, then I got my federal file number in Oct.. My bf is still a university student. After all these years that I gave so much for my PR, I wanted to help him and make his life easier. So I’ve been thinking to include him in my PR application in Sept.2018, by then we will be living together for 12 months. I have a few questions: 1. I heard if he’s not qualified then I will also be denied together for PR. So what are the factors that could make him disqualify? Also, he’s here on a student status but he only took two courses in the fall term, and this winter term he’s not taking any classes cuz all the courses he needed to take were full, and he’s working full time this winter cuz he needs to make money for his tuition when he’s not supposed to on a study permit ( but lots of students here do this, so I think this is a grey area?). So I’m wondering if this will be one of the factors that makes him disqualified? 2. How much longer approximately will be add on to my application processing time? Like I said, my road to getting a PR isn’t an easy one, I’ve invested way too much effort and time for it. So I cannot risk the chance of being deniedbecause of him if I include him in my application, nor do I want to wait if by doing so, the processing time will be significantly longer, as you all know, now the processing time is 18 months, too long for me already! 3. When is the deadline to update my common-law status with CIC, is it before I get my medical exam request?

Your boyfriend is working illegally. It's not a grey area. It's very black and white and it's not legal for him to be working. I would recommend he stop immediately before he's caught. It's possible the school has also reported that he's not attending school in which case it's possible CIC may have canceled his work permit. If that has happened, then on top of working illegally - he's also now in Canada without status.

Once you hit 12 months of living together, you will be required to include him in your application as his common law partner.

I am sorry, but I don't think that this is the right approach for this immigration stream. Spousal or common-law sponsorship apps are not meant for people to simply help their boyfriends or girlfriends. I hope you take it more seriously than that, because it is a very serious matter. Although you are not referring to this kind of app, I think it would still apply to my argument. I would think first about making sure it is a relationship that would be strong enough to last for a very long time at least. Like Scylla said, it is not up to you to add him or not to your application once you have become common-law. If you fail to include him in your application after you've become common-law, you would be committing misrepresentation, which could jeopardize your own PR status if you do get it. You could always do your own PR app completely by yourself, if you haven't yet become common-law, and then sponsor him afterwards. Also, note that this is the family class section of the forum, so it's not the best place to ask PNP related questions, as most of us know more about the family class and not much about PNP.

Thank you very much Scylla for your warnings and concerns. I will share your opinion with him. I’m not so much worried about giving misrepresentation because if he’s risking a chance of being denied when I include him in my application, because of him not taking full time classes and working at the same time, I can always choose to stop living together with him anytime, living together is nice, but it’s not like we have to live together.

Also, I know his plan, as soon as he graduates, he will find a job and try to get the PR ASAP. He’s not from a really wealthy family, they’ve had struggles supporting his studying and life here financially from time to time, that’s why he also needs to work to share the cost. Also, he wants to extend his education and get a master’s degree. That’s why I’ve been thinking of adding him in my app, so in the near future, he can work as much as he needs, while being a student, without worrying about breaking the rules; pay for tuition as a local student instead of expensive international student price. Also it saves so much time for him. Also, the reason that I posted it here is that now I’ve already passed the PNP stage, so I only have to do with federal, and adding him in my PR app to my understanding, has rather more to do with family forum. I think the main issue is having him stop working immediately and leave the country first. If you want him to be able to migrate to Canada someday, he has to stop being illegal in Canada. When the CIC looks into his file someday to determine whether he should be allowed to stay in Canada or not, his actions now will have major consequences then.

Thank you Sulwyn, I now know it’s a serious matter so I will suggest him stop working right away. His study permit is still valid, so he should be fine staying here, he’s waiting to take summer courses, cuz all the courses he needs to graduate were full this winter term.

This section of the forum is for family class sponsorship which is meant for PR (already landed) or citizen to sponsor their family.
You will get more help in PNP or other immigration path forum instead of this one.
Adding him to your PNP application is very different from apply for spousal/family class sponsorship.
