Claiming 15 marks for siblings in EE

Hi all, i want to ask! can i claim 15 marks for my spouse sister who is Canadian citizen but NOT living in Canada?

As per IRCC:
You can earn 15 additional points if you (or your spouse or common-law partner who will come with you to Canada) have a brother or sister who is:
  • living in Canada and
  • a citizen or permanent resident of Canada
So, both conditions have to apply to get the points. That is, she has to be Canadian (or a PR) and living in Canada.

Um...I wouldn't recommend it; the requirements are that the sibling must be 1) 18 years or older, 2) a Citizen or Permanent Resident, and 3) physically living in Canada. If you can provide proof of physical residency for your sister, then you can try, but I wouldn't necessarily recommend it - I'm sure Canada is capable of knowing which of their citizens are physically resident at specific times...

Dear All, further clarification is required on the same issue. my sister lives in Canada (Quebec). She has her PR approved and in the process but she hasn't received her PR card physically till yet. She has bank account on her name, utility bills on her name and health card to prove that she lives in Canada. Can i claim her 15 marks in my profile?
- Bank statement/Utility Bills/Health Card, i believe are enough to prove that she lives in Canada.
- She is more than 18 years old, the second condition which is also fulfilled.
- 3rd condition is that she should have Canadian Citizenship/PR, in her case she has PR approved which can be proved by providing relevant documents.

Please advise

When you say 'PR is approved and in process', what do you mean exactly? If she doesn't have her PR Card yet, that's fine (you can use her signed COPR as evidence of permanent residency) but if she hasn't LANDED, she's not a PR yet. Being 'approved' (i.e. having your application approved) is different from actually claiming your permanent residency status (landing and getting your COPR signed)...

Dear, i have mentioned that she lives in quebec, she is living there and applied immigration from there while she was in Canada and she got approved by judge followed by her case in court. now her case has been accepted and she is waiting for her PR to be received.
from time to time she is receiving her documents like Health Card, Authorisation to work, got admission in one school which is also supported by government. so i can use her 15 marks, right?

You still haven't answered crescent_jam's question. Has she finished the landing process? Does she have her COPR signed?

she went their on visit visa and applied refugee case, does she has to finish the landing process? and no she hasn't signed the COPR, i just asked her. she says she has fill the application form for PR and that is in the process to receive.

As already stated by crescent she is NOT a PR until she finishes the landing process. That is, you cannot claim those points at this point in time.
