I'm surprised that so many out of status applicants are from the US, yet there are tons of people who can't even get their non visa exempt spouse a visitor visa because they have a supposedly "high probability" of overstaying their visa. Yet it seems like the Americans are the ones overstaying.

This is one of my biggest frustrations with the system!!! Why deny so many visitor visas because they may overstay and yet there seems to be zero consequences of visa-exempt people overstaying? Either it's wrong and there should be consequences or it's not a big deal so don't deny visitor visas because there could be some small posibility of them overstaying!

It doesn't matter if you are "doing it out of your heart". If it's defined as work under the law, then it it illegal.
If that was a restaurant establishment thn you should not do that. You can volunteer at non profit organization e.g. churches helping out in their kitchen etc.

exactly. cbsa needs to toughen up.

a volunteer job is any job that is marketed to the community as volunteer work. if it's marketed as a job with pay for a canadian and a foreign visitor is doing it for free as a volunteer, CIC and CBSA see that as working illegally. why? because if you weren't willing to do the job for free, they would have paid a canadian to do it. if they wouldn't pay ANYONE to do the job, then it would be considered volunteer work. it doesn't matter if the place is non-profit or for profit. what matters is how that job is marketed and whether a canadian would be paid to do it if you weren't. payment can be money, food or any other incentive. volunteering can be a very slippery slope. just because you may not feel it's taking a job away from a canadian, doesn't mean CIC or CBSA will see it like that. if you want to volunteer, then you want to look for jobs that are marketed to Canadians as volunteer jobs.

When I went to hire a lawyer (from Kitchener, ON) they quoted me a $10,000 retainer. We did pay the $300 advice visit and got specific details and instructions how to deal with specifics of our case. The rest we have done.

It might be worth a visit to a lawyer, and take the questions that you have raised already with you. Take notes while you are there and asking about them -- you paid for the advice! You could also consider a trip to a land border to cross back into the US and come back to Canada.... at least you'd find out if they have a problem with your over-stay, and you would score (possibly) another 6 months as a visitor to get this sorted...

Are you in Kitchener-area Ontario? If not, it's probably better to find one local.

You can do it all yourself. I found that the initial consult was a was of money, to be honest...
