Hey All,
I am new to this website.
I have a few questions when filling in EE application online.

1. Marital status: My husband and I have separated since September 2017, but we didn't sign any legal separation agreements, and we haven't filed for divorce yet. Should I select "Married" or "Legally Separated" for this part? Besides, he is a Canadian citizen, so he won't be included into my application anyways, but if I select "Married", what documents are required to submit for his side (e.g. his medical exam, his police certificate...) for EE? Or if I select "Legally Separated", is it necessary to get a legal separation agreements to prove that and what else do I need from his side? (It is just so frustrated, we haven't contact with each other after we are physically separated, and I don't see that happening :()

2. Family: How many family members do you have? Should I select 1, which is just myself, or 2 (him and me, we don't have kids)? Is he still considered as my spouse or partner after we separated?

Hello Gk1990, sorry to hear about your situation and not that I am an attorney, but I will try to answer the best I could but I would really seek an attorney's advice since relying on answers from this forum may not do justice to your situation.

1) Does your passport have your spouse's name on it? If yes, then you have a bit of work to do. For e.g you technically cannot say you're married anymore since you do not live together anymore. In that case you have to select an option "Legally Separated" BUT you have to have a separation document produced, either an Annulment or Divorce but since Divorce procedure can take up-to 6-8 months it may be a while to get a divorce paper.

2) The moment you say 'Married', all the corresponding questions pertains around your current situation, which is, they will ask if your husband is Canadian citizen, etc. You cannot lie in those areas since in the next course of questions you will have to provide Passport details which obviously be Canadian passport.

3) Again, as soon as you mention married, all the documents has to have spouse's info too, like Medical, Police Verification etc.

4) Once you're legally separated then you do not have to mention anything about him and you can apply an application as a 'Single' person.

I'll just clarify one thing concerning this point. not all countries require married women to have their spouse's information on the passport and passports can still be in the maiden name despite being married. nothing unusual

We got married in February 2017 in Kitchener Ontario. Before I could get his name added on my passport, we got separeted due to unfortunate circumstances the very same year. We haven't spoken ever since. And I am sure there will be no cooperation from his side. We are not legally separated, or divorced because of the mandatory one year separation period and it's been just four and a half months.

If I have a copy of his passport.
If he is a Canadian citizen so will he need a medical or police clearance if I state that I am married to him. Which I am!
I am lost here.

I am sorry for your difficulties, but it doesn't matter much if he is a citizen, he is NOT a co-applicant and therefore does not have to fill out any forms, complete medicals etc. Unfortunately the application process assumes a spouse is a non-citizen so it is a challenge to figure out how to handle it.

List him as a non-accompanying spouse. You are still married so you will need to upload the marriage certificate etc. The "system" will still likely ask for PCC, medical for him but all you need to do is upload a brief letter of explanation stating that your spouse is a Canadian citizen, and include proof (e.g. copy of passport or birth certificate).

It would also be good to include a LOE that you and your spouse are separated, date of separation, and provide his contact info.
