Undeclared marriage

hi,
My mom was a live in care giver for 2 years and applied for pr status and included me(her daughter) and my dad in her application year 2009.

It takes us 7 years of waiting until we got approved for the application due to my dad medical issues.

Apparently I got pregnant with my boyfriend while I’m still studying (4months after we know each other) and my grandparents decided us to get married immediately for traditional reason. (May 2016)

The day before our marriage we got the approval of our application and tells us to send our passports in the visa office.
We didn’t have a chance to cancel our marriage that time.


After 7 years of waiting. We decided to not declare the marriage because we know that it will add another time for us to wait.

I landed canada as single (august 2016)

My question is, I wanted to sponsor my husband. What should I do?
I know I committed misrepresentation.
But can anyone advise me so that i know what and where I should start

It may sound harsh, but there is no way that you can sponsor your husband forever, because you didn't declare him.

The only way that you can do is to renounce your PR or citizenship, then you apply to immigrate to Canada from the scratch, and this time do declare him in your application.

No, it is not possible. He needs to be physically in Canada, in order to file the H&C. And even he managed to get TRV to come to Canada to file the H&C, to the best interests of a child is only one factor , and it is usually not a determination factor, that probably will go favor of your husband. I believe the chance is very low for him to be approved.
And you know what? If you submit any application to CIC for your husband, you are opening doors to CIC to investigate your misrepresentation, and you probably will lose your own PR or Citizenship. Misrepresentation is a very serious crime in the Immigration Law.

No - H&C will not work since your husband is no longer considered to be a member of your family since you failed to declare him.

You should also be aware that you obtained your own PR status through fraud (by lying about your marital status at the time of landing and not declaring your marriage). Once you were married, you no longer qualified for PR as part of your mother's PR application. So if you attempt to sponsor your husband in any way, this may cause CIC to review and revoke your PR status because you were not entitled to receive it.

As others have said, your husband either needs to qualify and apply for PR on his own through an economic immigration stream like Express Entry - or you need to give up your PR status, return home, and then you and your husband can apply for PR from scratch together. Those are your only options.

If you submit an app to sponsor him, the app will be rejected by the visa officer since you failed to declare your husband in your own PR app. You can then choose to appeal this as is your right. The appeal date can take a year or two to schedule. Simply having a child in Canada is on it's own not really a valid H&C claim, and the most likely scenario even if you appeal is that the appeal is denied. As an additional step, or even once your app is initially rejected, IRCC may or may not decide to investigate your own PR status due to the fraud/misrepresentation you committed when you landed as PR. I am not sure if they would also investigate your parents as well, if they knew about the marriage but did not update their application so may also have been seen to have committed misrepresentation.

If your own PR status is revoked, you would be expected to return with your child to your home country. You may then also face a long ban from ever applying for PR to Canada again due to your misrepresentation.

The safest option for you to ever live with your husband in Canada, is not to submit any app or appeal anything with IRCC. Your husband should concentrate entirely on gaining the education/work experience that will qualify him to apply for PR on his own through another immigration stream. If he can do this, then even though he would list you and his child as PR/citizens of Canada already, IRCC will not bother to investigate you since you are not applying for anything.

so if I’ll be honest to IRCC that I commit misinterpretation. Did my child would be affected? Did she will lose her Citizenship?

Can she sponsored me and my husband in the near future is she’ll become eligible?

Once your child is 18, has met LICO for 3 years prior to entering the PGP lottery, they might be able to sponsor you(if they get picked) when they are 22 years old. And that would be contingent on the PGP program being the same as it is now.

I didnt get it. Can you explain me more? She will be not deported if I’ll be deported ? Cuz I think there’s no more way that we would be together. Sad but I think that’s the reality

So the right age that me and my husband will be sponsored by her is 22? And it’s not still that sure?
