Inland vs outland

Hi everyone,

I am sponsoring my common law partner with whom I have been living for 5 years and we have a child together.

We currently live in Argentina and we are moving to Montreal.
Our son and I are flying in May and my partner in June.

We are working on applying for sponsorship this month "outland". I am now having doubts especially because we want him to be able to live with us in Canada (even if he is not able to work and has to extend visas etc...)
I am reading everything we need to get ready etc... over and over again and yesterday I began doubting.
Would it be better to sponsor him from Canada with an inland application? Can we do that if he is only there with a tourist visa?
If we apply for outland, is it feasible to get him a visa to stay in Canada while they review the application?
Long separation is not an option because of our child mainly.

Any opinions or experiences?

Also...the Quebec application asks for proof that I am residing there but I am not yet. Would it be enough to show air tickets, communication with my family in Canada talking about the move, my sister from Quebec saying she'll give me a hand and can't wait to be close again....?

If you don't plan on travelling back to Argentina during the processing of your patterns permanent residence, then you could wait until you both arrive in Canada and then submit an inland application. You can certainly submit this while he is on a tourist visa in Canada, and then you can also submit an Open Work Permit with your PR application (this can only be done for inland applications, you can't apply for an open work permit with outland). This takes ~4 months to process, and after that he can work in Canada whilst his PR is being processed. That way you can all be together.

Regarding the CSQ application for Quebec, you do need to provide proof that you are actually living in Quebec (they ask for electricity bill, cable bill etc). You will receive an invitation to apply for this shortly after you receive your AOR (i.e. ~2 months after you submit your application!).

One more thing to add is that with an inland application, you don't have the rights to appeal, should your application went south, while with an outland application, you do have the rights to appeal, if the decision didn't go to your favor.

With a valid TRV and future extention, your partner can be staying in Canada for the whole process, even you file an outland application, the only difference from the inland application is that your partner cannot work, since an outland application is ineligible for an open work permit.

Now; if we go the inland way and wait until I get to Montreal and have bills to show; when my partner has to get police clearance and do his medical, he THEN has to come back to Argentina. Correct?

No, he doesn't need to, either you file inland or outland. With an inland application and open work permit application (File both together), just make sure that he doesn't lose his status before his open work permit approval (it will take about 3-4 months to get approval). After his open work permit approved, he doesn't even need to apply the TRV extension, because an approved open work permit will grant your partner an implied status, which will allow him to legally stay and work in Canada, till the decision made of your application. With an outland application, he needs to keep extending his TRV through the whole process though. With an inland application, actually he cannot leave Canada through the whole process, otherwise, your application will be denied. (A short period leaving is allowed, such as 2 weeks, but any period longer than 3 weeks is not recommended)

The only concern I would have with this is if, for exemple, something happened to someone from his family; I imagine death or a serious accident would be accepted as a reason to leave for a couple of weeks?

I am a Candian citizen and my son will soon be. We just got the email saying they got the application for his proof of citizenship.

Then I believe that there is another thing you may pay attention to, I am not sure, but I think that if you file an inland application, both of you and your partner need to be physically in Canada. You cannot file an inland application while you are aboard. Correct me, if I am wrong.

You're right. An inland application would have to be sudmitted once we are both in Canada.
My doubt is; what if before my partner gets his PR, he needs to travel to Argentina? (In the case of an emergency or serious event)

He will need his medical and police clearance regardless if you choose to apply outland or inland.
I am not familiar with procedure of getting police clearance from Argentina.
But he can sure get medical done in Canada. (either for inland or outland application)

Ok. So, medical can be done in Canada and police clearance depends on the country. We'll find out if that can be done online then.
