Welcome aboard! Sorry for my delay -- I was in a meeting at "the dreaded day job".

I will see what I can do. I am no expert ,and I am not well versed in refugee processes. But, let's see where we get.

First off: they are still processing in October for 2016 cases. So, not having eligibility passed may not really mean anything.

Second: are you the subject of a removal order? Correct me if I am wrong, but isn't a removal order issued at the start of a refugee claim?

Third: how difficult would it be to get a travel document?
Thank you for the reply.
1) yes I am but they havent issued me a removal date yet because I do not have a travel document. They sent me a letter three years ago where it stated in the letter that I am the subject of a removal order. My PRRA had a negative decision as well last year. To be honest, I had a lawyer who completely ruined my refugee claim. It was just one document that messed up my entire claim which was submitted by her. Anyway, what has happened has happened and I try not to think about it.
2) Getting a travel document is very difficult in my case.
I saw that the lawyer who did our spousal application mentioned something about H and C because I dont have a travel doc.

Ok, and you have an inland spousal sponsorship application in, right? Not outland?

You bet! I live only 45min north of Hamilton. Either city name would have had me sure you were in the province. You'll likely land at the Niagara Falls CIC office.

My wife landed and immediately booked a return trip to visit friends and family. Her PR card arrived at 65 days (when they had them timed at ~65 days). About a week later, she left for Moscow. Upon returning, she made an error on her declaration card (value of goods she was returning with). Not only was re-entry simple, they even helped her to fix the declaration (and didn't bother to search!). The story is offered to show, there is no issue in coming or going.

That said, you could renew your passport through an embassy/high commission -- at least, usually you can. That means, you technically could do it now, if you so wished. IF you do this, make sure you scan and send the bio page to CIC via IRCC web form (google ircc web form). Just make sure they have the new number on file before you land.

The PR is the COPR document, and a card. No real stamp (though some like to put an entry stamp for decoration in your passport -- there is nothing legal about it).

@profiler - today I check online tools about our application... it showed Decision made for both side, sponsor and applicant.. but at CIC account (GCkeys) it is still stuck the same >>> Final decision - Your application is in progress. We will send you a message once the final decision has been made.

is that really decision made ? or it is just error? ; I am really really nervous now.. oh my...

yes, I think we can make the passport at here, but I was planning to go back to my country and just renew it there because my passport still has 1 year age, do you think it will be okay? I mean after I receive my PR card ; because once we make new passport, the passport number will be different with the old one...

oh, you living nearby Hamilton! if you free or okay, we can meet up! I would love to buy you a cup of coffee for all help you give to us!
thank you so much :)

ECAS is more accurate than myCIC. Congrats on your decision made, you're done and waiting for a landing appointment. You might receive an official letter stating that the processing of your application has been completed and that your file will be transferred to your local immigration office for finalization (DM letter). Your myCIC account will likely be updated only after you officially land.

So if your passport still has one year, there is no need to renew it now. You can do after you receive your PR card either here with your embassy or in your country of origin.

BTW, you have more chance to meet @profiler if you offer him a craft beer than a coffee :D!

Congrats. You'll be landing soon. That's a DM. As @sylvain1 said, Craft Beer is like honey to this bear...

Don't change your passport now that we know you have a DM. Just wait until AFTER you land.

Yes I have an inland sponsorship in. It was filed on Nov 2017.
H&C isn't really possible, because they don't like it when you switch streams (it's technically inland, with the added component of you telling them what regulation you want them to close their eyes to, and why). You can submit the paperwork via IRCC and ask for H & C, if you choose (it's the same cost and everything). In that case, I would be looking closer at IP-8, specifically, start at Pg 21. The regulation you want them to bypass is R72 -- the requirement to have a valid passport or travel document. In your paperwork, where you identify R72, you will have to explain why -- explain that you had a refugee claim (and explain that briefly), then explain that you had poor representation. It won't be the reason they choose to look past the regulation, but it would certainly help pull on those heart strings.

IP-8: http://www.cic.gc.ca/english/resources/manuals/ip/ip08-eng.pdf
the Regulations (IRPR): http://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/page-14.html#h-36 <-- scroll to find 72
and, IPRA: http://laws.justice.gc.ca/eng/acts/i-2.5/

A waiver is also a possibility -- but that would be available only if they process under public policy (which it sounds like they might!)

HTH!

Thank you so much for all the information. My husband and I have been so stressed out about our application. We have never been given a straight answer like this, so thank you @profiler. My situation sure is very complicated but we are hoping for the best.

Sure thing. Challenge, accepted.

Here is the H&C application (https://www.canada.ca/en/immigration-refugees-citizenship/services/application/application-forms-guides/humanitarian-compassionate-considerations.html). If it was me, I would fill out the form that asks what regulation, and I would submit to CIC via IRCC web form. With your submission, ask for Humanitarian and Compassionate consideration.

The worst they can do, is say no to your request, right?

If this fails, you can reapply again, and at that point, file the proper H&C application package...

When was your landing interview, again? Did you try calling the call centre? I have heard of cases where they have trouble with the pictures submitted, and they need others -- which causes delay. The call centre can tell you if a card has been dispatched or not...

Hi guys, long time listener first time caller....

I've been checking in on this thread since I started my Inland Process back in December 2016. Im a US citizen applying under family sponsorship. Long story short I had my landing interview today. Things were pretty easy and streamlined for me through the application process. You guys provided great info on everything from tricking the system to get online access, to under standing what the process was like.

There are 2 issues I had I wanted to bring up in case other people experience it.

1- when I submitted my background check after they requested it, they took a long time to process it. Just be aware.

And 2- I had a unique issue today. I had paid all my fees upfront, and had the receipts to prove it. At some point in November CIC refunded me a random amount of like $340 that I would have missed had I not seen it on my credit card. So imagine my surprise when today I showed up with my receipts and they told me I had to pay my $490 landing fee again. The clerk mentioned this wasn't the first time they had seen it, but thought they fixed what ever glitch was causing it. They did allow me to step out of line and make the payment online (on my phone) to continue with the landing. So I guess I need to get that cleared up.

Other then that the landing process here in Calgary was quick. It was quite unorganized but the lines moved quickly. Was in and out in about one hour.

Good luck to you all and thank you for all your help!

Congrats on Landing!

$340 is because you likely applied for an OWP, but didn't pay $255 (155 + 100 for the OWP holder fee). They deducted the missing amount. When they could not attribute the $340, they sent a refund.

Fees:
$1040:
- $75 Sponsorship application
- $475 PR application
- $490 RPRF

OWP:
$255:
- $155 Work Permit fee
- $100 OWP Holder fee

When you don't include enough, they will deduct from the escrow account. When they encounter <$490, they just issue the overpayment refund, and expect the RPRF later.

In our case, the online system charged an extra $75. That was refunded after they took the RPRF.

This feel so good to read it .. :)
I am feeling anxious to read and to know what will happened next .. I hope all settle down faster :)
Thank you so much

Yea, I will change my offer from coffee to beer for @profiler - let's have some beer! :D - let me know!!! yay!
I will be happily to have new friends here as well :)

Just really want to know..

How it is normally if the CIC reject the application?
is it possible Decision Made, but the result if they reject it?

CIC will not just reject a file. You will get a procedural fairness letter before they do. As you've seen.

This, is very much a positive decision.
