Express Entry Question - Use Job offer from same Employer?

Hello,

I am on H1B VISA in USA from India. I am working in IT sector in a MNC company (my employer is not based out of India).

My employer has recently filed EB2 but I know I might not get GC before 25 years. I now wish to immigrate to Canada as I believe I have skills to contribute to the growing Canadian economy while ensuring stability of my job.

I am studying Express Entry platform. I understand a job offer from Canadian employer will give me more points. My employer has an office in Canada. Can I use an offer letter from my same employer?

Does my employer need to do anything besides giving me offer letter? I don't think they can sponsor my PR in Canada as they are already doing my GC in USA but I can workout something with them that gives me opportunity to work for them in Canada once I get my PR.

I hope I am making sense. I am totally new to Express Entry so any guidance will be helpful.

No, what you are describing is not a valid job offer and thus no points will be awarded for such letter.

Thank you for your response. So, following are my options (apart from maximizing my other scores):

1) Get job offer from Canadian employer
2) Get sponsored by a Province

If I get sponsored by a Province does it mean an employer is ready to hire me in that Province or is it just an interest shown by a Province (and I still need to find an employer)?

You'd still need to find an employer if you were to be sponsored by a province.

I have one more question. My Client has an office in Canada.

If it is allowed, can I have my Client give me a job offer in Canada? I know I might need to work out the employer-client contract but if that works out fine then I should be good, right?

No. Like I said, what you are describing is not a valid job offer. Please refer to the link I posted and read it carefully.

With all due respect, I don't find anything on that website that gives me an indication that this is not possible. If my employer or my client is ready for LMIA then wouldn't it work (assuming my NOC code is all fine as well)?

Are you saying this because it is generally tough for employers/clients to do LMIA? I think I am still following all Express Entry requirements unless there is something I am not seeing there.

That's a whole different story, you never mentioned that your employer would go for LMIA. Assuming they are willing to spend the resources and that you actually get the positive LMIA then sure, you'd have a valid job offer.

@DelPiero07, Is @dacoffee acquiring a work permit under ICT(Intra-Company Transferee) provision, which is LMIA exempt, an option, assuming his employer is willing? That also implies he will have work in Canada.

ICT visa requirements are different.

He will have to work in Canada for 1 year before he qualifies for 50 points under job offer.

All the best @dacoffee!! Calculate your scores and see where you stand and then make the decision. Take a look at the previous rounds of draws and the cutoffs.

Apologies for my ignorance too. Can you please direct me to the verbiage where it says that i need to work in Canada for 1 year in case of Work Permit Intra Company Transfer.
