Hi All Members,
I have applied for PR for my parents in 2106 and they send me letter December 2017 that your 2012 income was not match with minimum income requirements. They refuse my application from New Delhi. Even after 2012 I have maintained required income.
Should I send my details about my current status to the New Delhi OR go for the appeal.
Is it good to go for appeal?

No point appealing unless you believe they made a mistake in saying your 2012 income was too low and you have proof they were wrong. Did you check to make sure your 2012 income was good before applying? Or did you just apply despite a low 2012 income and was just hoping for the best?
 
Did you meet the income requirements in 2012 or not? If you did not, there is no point appealing since you didn't meet the minimum requirements to apply.

Thank you. But i do not know why CIC is worried for my 2012 income, which is almost 5 years back. They should consider the current status of sponsor.

It sounds like you aren't familiar with the rules for parent sponsorship. CIC consider both past and current income.

You applied in 2016. To qualify to apply in 2016, you had to meet LICO for the previous three tax years available which was 2012, 2013 and 2014. If you didn't meet LICO in one or more of these years, then you didn't meet the requirements to sponsor your parents in 2016 and should have waited.

Again, your 2012 income (also 2013 and 2014) needed to meet LICO in order for you to qualify to apply in 2016. I'm not sure what's confusing about this. This is a minimum requirement to qualify. You didn't meet the minimum requirement to qualify. You were correctly refused.

A firm rule for applying in 2016, is that you need income meeting LICO from 2012. This was very clearly stated in the application you did, did you not bother to read it? You should have waited until 2017 to enter the lottery.

It's certainly your right to file an appeal of the decision. If you do, expect a long wait (1-2 years) before your case is actually heard for appeal. At an appeal the judge will consider any H&C reasons or extenuating circumstances that the income rule here should be waived for you. If the appeal is granted, your app will go back to visa office to continue process. So best estimate at least another 3 or so years to complete.

Or in the likely scenario the appeal is denied, the app will end and at that time you'll need to start again from scratch by re-entering the lottery (or whatever rules are at the time).

In the meantime, you'll have missed out on many years that you could have applied to lottery and actually qualified.

I have same situation. We didn't meet the MNI for 2012 We were short around $200 and the IRCC however they transferred my parent's application to local visa office in Manila for reconsideration then after few months past they requested an evidence in order to support our income so we sent our 2015 and 2016 NOA to LVO Manila which is good then after 8 months of waiting for any AOR or refusal letters because I know they will refuse it eventually but I received a Pre-Arrival Letter last week of November then after 5 days after I got the Pre arrival they asked for RPRF, PCC and Medical for my family. All requested documents are already been submitted and now I'm waiting what will be the next decisions for VO. I am still hoping and praying. My question is if they will refuse our application they why we received a Pre-arrival letter for orientation? I know 99% they will refuse it but 1% chance because of that pre arrival letter, if we got refuse then they should stop sending pre arrival letter after all its useless.

I think we have same situation. Just want to ask Before you receive your refusal letter did the NVDO sent you a request for medical, pcc and rprf? Im worried because i wasn't approved to sponsor due to 2012 low income but I was only short for $200 but they still transferred our application to LVO for reconsideration so they asked another supporting docs in order to help our application so we sent our 2015 and 2016 NOA. Then I received pre arrival, rprf,medical pcc.
