Hi:

I had a dual intent approved LMIA, I´ve been working under this LMIA more than one year and I applied already to EE with the same one. My question is, I´ve been underpaid, in other words, I´m earning like 25% less than the posted wage in the LMIA. I spoke my employer about the importance of accomplishes what LMIA specifies, but they spoke to my consultant and he said worst case if they are audited they will have to pay all the wage that they didn´t pay so far, so they deiced to run under that risk.

That being said, I also feel that I´m the lowest wage along my co-workers, even when my previous experience on this business is about 10 years (that´s why they wanted to hire me).
My question is, there is something I can do without wounding my self? I don´t want my LMIA to be revoked or to stop working, even more when I´m in the middle of the EE process, but at the same time I think this situation is frustrating enough. Anyone has been in the same situation? Or know how ESDC proceed in fact in cases like this??

If you report your employer to the ESDC, they will investigate him/her company and if found there is a need for revocation then all LMIA work permit issued will also be under investigation which may or may not results to loss of job depending what is the outcome.

Your employer is violating the terms of the LMIA. Worst case scenario - your employer is audited and is then blacklisted from obtaining future LMIAs. Could definitely create problems for you and your EE application.

It's not a simple matter that your employer would just pay all of the wages they haven't so far. If it was that easy - everyone would just cheat and wait to be caught.
