Question regarding Change in Status

Hi All,

A short summary of my PR Express Entry application timeline

Residing Country : USA
Citizenship : India
Got ITA : October 2016
Fee Payment and Application Submission : November 2016
Relationship Status was Single
Got Married : April 2017
Received an email to mail out my passports : December 2017

The first step mentioned in the email is to update CPC Ottawa on any changes in the relationship status, My wife will not be accompanying me as she is waiting for Masters Admission from Canada.

1. Would declaring my wife's details impact her Masters Admission prospects? Does CIC make it mandatory that your wife should also get a PR application? Because I don't want her Student Visa to get declined because of me declaring her as my dependent and it's a headache to have multiple applications pending for a long time.

2. What is the best way to disclose my relationship status change so that CIC doesn't request to file an application for my wife, pay the fees and make her to take medicals? What would be the worst case waiting time? As mentioned, I already waited a year to get a decision, so want to be prepared mentally for another long wait.

1 - No effect on her admission.

My question to you would be, why the heck haven't you updated IRCC on your marriage? You should have prepared all her documents back in April so you could both get PR as adding her would not have resulted in a recalculation of your points. You shot yourself in the foot here.

Now you should raise a CSE or contact your VO and prepare to get a request to provide the necessary documents (marriage certificate, medicals, PCC, etc).

Whether your spouse is accompanying or not is irrelevant and won't accelerate the process. You are still required to provide her medicals and all the other forms. At this point the best approach is to add her as accompanying unless you are unable to meet the required funds for two people.

VO = Visa Office btw.

It makes no sense now to declare that your wife is not accompanying. You will have submit the same set of documents and processing is not quicker since she will go through same checks anyway whether accompanying or not. It is better to add your wife to your PR application. The bottom line is don't land before adding your spouse. Good Luck!

Thank you. Chances are that she will land into Canada before me (once she get her acceptance from the university). Would it cause any problem to either of us? The below scenarios can be dumb but I am trying to get an understanding of it

1. I apply for PR for my wife, while it is in process, she has to start her Masters and apply for Study Permit. Would it cause any issue?
2. Her Study Permit gets approved first, so she leaves before me to start her Masters. Will she be questioned at Port of Entry for having a pending PR application?

1. You don't have a choice her. You have to do it anyway. This should not affect the PR application, but keep in mind that there is no guarantee that the Student visa will be approved as it depends on her application.
2. No, if her Student visa gets approved, she can enter Canada as a student as long as she goes before you. In any case, she should be honest and answer any questions regarding the pending PR application truthfully which should not cause any issues.
