Hi,
I am in relationship with a lovely man. Met him 3 years ago. And have been living together since start of this year. We have not signed any contract or married.
After two years being in a relation, he flew back to his home country because his student status was expiring. But his stay back home wasn't safe. He was admitted twice in hospital due to assault (life threatening). So he came back to Canada and claimed himself as refugee. But it got rejected from IRB and RAD. Right now, he is appealing at Federal.

I am really worried for him and I do not want any harm to happen to him. Therefore, I am deciding to sponsor him as Common-Law.

But I got no clue, what sort of documents and steps I should take. Do I need to official sign document at court declaring him as my Common-Law?

I wish, I could marry him now. But my family is not ready to accept him yet.

Please someone guide me. Thank you for reading.

To qualify as common law you have to have been living together for 12 consecutive months with no long breaks in between. You will also need to prove that you have been living together with rental agreements, joint bank accounts etc. You can start by looking over the guide and qualifications in the ircc website

You can sponsor common law, but since he's a failed refugee claimant, its going to be a very long and tough road for him to get PR.

Be prepared to gather tons of evidence to show a genuine relationship

And have been living together since start of this year.
You will only qualify to sponsor him, when you've lived together for exactly 365 continuous days, with no long breaks in-between. So if he came back to Canada and started living together early this year, you would be common-law early in 2018.

There is no document to sign to make him common-law. You will need to prove this by showing proof of cohabitation like shared rental agreement, joint financial or other accounts, mail going to same address, testimonial letter from friends/family, etc etc.
