I want to keep this thread open for daily commuters using AVR. There is an updated notification in the USCIS site that most of the non immigrant visa holders will need to get a visa instead of automatically re validating their expired visa. This is a very rare scenario that I would like to keep track.

As far as I can see, there are no changes. It has been this way since long. You should read the page fully and not in between lines.

Can you tell us what was your understanding and what you feel changed?
Earlier till last month the word " is limited" was not there. I can understand the clauses have not it changed other than the incusion of arab countries but the sections have finer detail which only an attorney or immigration expert can decipher. I have been on avr for the last 4 years crossing daily and hope it is seamless.
 
Glad i have a printout of the old avr which i can post here if anyone wants to see. I hope there is an option here.
 
Here is the old one vs the new one. I would like to see if any of the daily cross border commuters faced any road blocks. In the last 4 years lot of officers have debated atleast once in 6 months in secondary for me ..they have called their central attorneys etc and I have had no issue. These publications get into effect by 4 to 6 months. Esp if they have referred to 8 CFR and 22 CFR 112 section d

I checked with my company attorney few days back on this as I need to use avr for landing. He didn't mention about any recent changes.

He just gave few links on avr and suggested carrying print outs of them. He also suggested carrying latest pay slips and employment letter. That's it.

He suggested to make sure that I'm properly admitted once I get back to US.

So do we get i94 online for the trip that we made using avr? If so will it have same number as the one in petition?
 
You will not get a new i94. They should stick the uscis receipt and stamp in your passport. Make sure that they do not make you attach the white i94 as that is not right. If you pay the $6 .. they are not doing right.

Thanks. What will show online if we put passport details in CBP site after our entry? Old expired date of last visa entry or new date will appear with the i94 number provided in the USCIS receipt?

Also, does it work the same way for air travel from Toronto airport?
 
It depends. If the officer scans the old expired visa whe online status will show the old expiry date and the old visa status.if the passport is scanned the new i94 details will show and display your current non immigrant status. Note that is avr you should not have an intent to immigrate at any point in time. Not even if your 140 or perm is processed or you could be denied entry.

Thanks. So both ways right ways to grant entry? I mean scanning passport as well as visa?

And once entered what should I check to make sure that I was correctly admitted in H1B class?
 
Would automatic visa re-validation apply if I have changed employers and have received the I797 approval notice (which has the updated I-94) for the new employer?

Technically, in all the documentation, I do not see any issues, thus searching for anyone who may have experienced this.
