hi I'm lost and not sure what I can do

hi my situation is complicated and I need an advise but please not people that have 0 knowledge and just misleading


I'm in Canada for 8 years all the time under work permits
I'm married + 2 kids (born in Canada )
I have retail supervisor experience for 8 years always under supervisor work permit my wife had an open work permit and she established her company in retail and wholesale 2 years ago she applied to a work permit under 0016 noc as a senior manager that got approved I was under her work permit 2 years open still in the retail supervisor and store manager .
we trying to apply for a pr but all roads are block both of us don't have any secondary education like university etc or profession , we both doing great income
I'm doing 50k a year she does 75k a year .
her business doing great and making great income ( 6 local employees in Alberta )
now as her work permit is over she already got a VP that run all the day to day operation she got a store manager work permit and went to work in a different company (I know the story is confusing but sometimes as you liable under work permits you do what you need to do to stay legally in Canada and to have health care and other things )

what can I do ? what do you recommend ?
just to explain now my wife got 2 years work permit as a store manager and I got open work permit for the next 2 years that will lead us to be 10 years in Canada with still now options to get out of this ridiculous cycle

you are technically a skilled person, have you calculated the points for Federal Skilled Worker program? Keep in mind that you only need a good score in English and have Canadian education, which will boost up your score.

There are college courses you can take, one year program is still qualified as canadian post secondary! Since you are in retail, why dont you try to take an online course/adult learning meanwhile you work as well? Once either of you get PR you can sponsor.

On the side, does she OWN a company or she works as store manager for others? thats indeed confusing ... there are other ways for immigration if you have a lot of money and assets and experience in the field as an owner or senior manager.

My suggestion would be, work on what you can. The following year's immigration should be looser

In regards to funds so we own our own house no mortgage 600K , and we have over 200k in the bank no debt and all great I didn't understand what you meant by ways to immigration from that as I mentioned I'm lost I went to a lawyer he said we don't have enough points

Higher Enlish test will help very little.
Here are his choices:
1. French - aespecially one on CBL 7 will give him 30+ points
2. Swap to Spouse a main applicant - would she get LMIA for her profession, she would get 200 points (00xx - LMIA).
3. Take any post secondary education (it does not have to be related to his profession) - That would trigger points for Lanugage and education and for Canadian education and Language
4. Get PNP - Alberta is launching new EE stream in January.
5. Do nothing and let age slowly decrease your points.

Just my two cents, but if you are going to try to apply for PR (with you as the primary applicant) through FSW or through CEC if your primary NOC is a Skill Type/Level 0 or A, you'll need to increase your CELPIP Writing Score to at least 7 in order to be eligible in that regard...

I'm not one to recommend reliance on consultants and even lawyers (there's a lawyer in my home country right now who has screwed over several of my friends in this process), unless you have a complicated legal issue attached to your case; I recommend double-checking your eligibility yourself before relying on your lawyer's assessment that you "don't have enough points".

Have you checked your eligibility for the FSW programme (see here: http://www.cic.gc.ca/english/immigrate/skilled/apply-factors.asp ) or the CEC programme (see here: http://www.cic.gc.ca/english/immigrate/cec/apply-who.asp)?

If you've checked and you are in fact eligible, have you checked your likelihood of getting an invitation to apply for PR (i.e. your CRS Score) (see here: http://www.cic.gc.ca/english/immigrate/skilled/crs-tool.asp)? Conventional wisdom right now is that, if you have a CRS Score of 435 or higher, you should eventually get an invitation...
