Applying Inland - TRV Help

Hi! I'll be applying indland shortly and my TRV will be expiring next month. I am also sending in an application to extend my stay as a visitor. Do I also need to send in an application for a new TRV as well?

Also? what should I put as "length of intended stay"? Should I say 1 year as that might be the approximate length I might wait for my PR application?

I would be hesitant to apply inland with your TRV expiring so soon. If you aren't approved for an extension, you would have to leave the country and your inland app would be void, you'd have to start all over. Are you applying for an OWP as well?

Yes I am applying of an OWP. So I would have implied status at least.

OK, that's good. Yes, you will have implied status, but only once you receive your AOR. Right now that's taking about 8 weeks. Prior to that, you would need to apply to extend your stay as a visitor (not submit a new TRV application) since you are already in Canada. Processing time for that is currently 118 days, and you would be covered with implied status during that time as well.

When exactly are you planning on applying? My recommendation would be to apply for the extension at the same time you submit your application. You are likely to hear back with AOR before you hear back on your extension. That way you would definitely still be in status when they received your OWP app (being in status is a requirement to apply for the OWP).

Sometimes people apply for visitor status extension also, just as a back-up in case something was wrong in their PR/OWP app and it's returned, they will not suddenly be out of status. But this is entirely optional.

Yes, that would be fine, as long as you submit your application to extend your stay by then as well.
A mistake a lot of people make is NOT applying to extend their stay, when their TRV or visit will expire before they receive AOR, assuming they will get implied status from their OWP application, and then the application is returned for some reason, then they are not only out of status but also can't apply for OWP unless they are able to restore their status. So definitely submit that extension app and you should be OK.

Apps are getting returned much more frequently in 2017 and I see posts from people at least once a week who assumed they would have implied status due to the OWP app, but then it gets returned and they're totally screwed. You can't actually know that you have implied status until you receive AOR. If your visit or TRV is expiring before you will receive AOR on your app, the prudent and wise choice is to apply for an extension. It saves a ton of trouble, especially with how frequently this has been happening.

No, you have implied status the second you submit any request for status, be it through a visitor extension or an OWP app. This is a simple fact. One does not need to wait for AOR before getting implied status, that is completely wrong.

The only issue is if someone has filled in their PR app or OWP app incorrectly, it may be returned which would then cause the applicant to be out of status. They would then need to submit a restoration of status app along with the next OWP app they submitted.

Again though, if one is confident they've filled in the PR/OWP app correctly and aren't concerned that it will be returned, they don't need to apply for extension of status also, it's entirely optional, although yes it is the most safest option to do. Some people though may prefer to take the risk and save the fee of the visitor extension app.

Hi

The validiy of your TRV has NOTHING to do with your status in Canada. The fact that your TRV is expiring soon means absolutely nothing in terms of applying to extend your status. You do not need to apply for a new TRV.

As said by Rob, you will get Implied Status by submitting the OWP app with the inland PR app. AOR has nothing to do with it. It is your choice if you want to apply for a visitor extension as well, just in case your OWP/PR app is returned.

Your visitor status is valid until March 10th. Don't bother submitting an extension. Just submit your PR/OWP app.
