Procedural fairness - 6 Months - No update on Application

Hi,

Before you reply I want you guys to read through to understand my situation because it is really complicated.

I submitted my express entry application on Jan 9th, 2017 under CEC. At the time I had 2 years of Canadian experience and little more den 1 year of foreign experience both of which I claimed points for in my profile.

After submission I faced first problem regarding my medical as it was not cleared right away, turned out I had a tumor which required surgery. bcoz surgery was serious I went back to my home country and finished my surgery there and submitted reports to CIC. After that My medical was passed which was in April 2017. and application progressed.

Soon after a month I received a procedural fairness letter, saying the foreign experience I claimed CIC have question regarding that. Bcoz initially when I applied for study permit I didn't mentioned that experience. I didn't show the experience at time of study permit bcoz I was still working and didn't wanted to tell my employer that I am leaving, and had no supporting document to prove my employment. I replied to the PF letter with the same reason and provided as much proof as I could(employer contact, Payslips etc, employment letter) I recevied this query on May 3rd and I responded on May 7th since then I have no update on my profile.

Now as mentioned earlier bcoz my personal health issue, i decided to stay with my family until I get certain response on my PR application, and I decided to notify CIC of the same to have my address and contact information changed. I did that by submitting a web form and provided all the details.

It's been now 6 months since I heard anything from CIC regarding my application, in the meantime I submitted 3 web from to enquire about my application and everytime I got same response saying "Application is in progress, will notify with message in your account if anything changes"

I don't know at this point what I can do much. I can't contact call center from where I am, submitting web forms seems useless now since I get same response

At this point my application status say we are reviving your eligibility, and it says application is in progress. BG check is not application and med passed. this is been same for past 6 months.

So I am just looking for any insight you guys can provide or anything that seems logical explanation on why my application is taking this long.

It's always a "good" sign to receive a procedural fairness letter instead of an outright rejection. The way your described your situation you probably did the best you could.

However, as soon as you get one of those, topped with your medical history and change of address, any predicted time frame goes pretty much out of the window. I'm in a similar boat. Best you can do is order GCMS notes to get a more concise idea of where your application stands and well, wait.

I thought of GCMS bt I think that's only applicable if you are residing in Canada. I left Canada so I am not sure if I can apply for that.

I feel like it's dragging way to long I just want some kind of resolution or update asap

Wow! They will probably delay your application for a while, then ask you to do another set of medicals to ensure you are fully okay.

I applied in March 2017, with no medical examination done for my stepson but provided other documents for explanation. Till date I have not received a single communication from ircc other than the reply to three query mails sent to cpc Ottawa. I requested gcms notes from getgcms and I have no issues about anything as the notes come in around 30 days and I know the file is in progress with comments to know what is happening. Our timelines will be different. My file is now at ndvo.

You can as well order and see what's happening with your file. It's safe to order from getgcms. thanks

So I finally got a decision in my application and it's rejected with no misrepresentation or ban to enter canada.

Yes they didn't accept the foreign experience I mentioned bcoz that was not mentioned in any previous application like study permit or work permit

Yeah, I'm sorry to hear this but you have to disclose all your past and present employment history an all your applications from the first point of entry.

So now that you can't claim any points for the experience you had while in your country, how much points will you have with just the Canadian Experience? And did you say they cited misrepresentation and that you are banned from entering Canada???

No misrepresentations luckily and no mentioned of ban in refusal letter. It just says I am not eligible for the draw I got invitation for and hence they refused my application.

And even without foreign exp, I have around 440 points so I guess that would be enough for new application and with current trend of cutoff.

Only things is new application would be little unique as I'll qualify for cec bt no living in canada and also that would mean complications wiyh POF as do I need to show POF or nt bcoz CEC applicant doesn't have to provide pof bt non canadian residents have to so..
