Including step child in permanent resident application

Hi All,

my spouse has a minor child from a previous marriage, and doesn't have the custody which will prevent the child to accompany the family.

1. for permanent residence application first questionnaire, they are asking if the main applicant is parent or guardian? and no other choices...i am neither the parent or guardian..what should be answered in this case?

actually both answers will lead to include him in the application as a non-accompanying child, and as far as i know he will be included in Medical check & counted as extra one in POF.

2. filling the personal details in primary applicant >> Family section , for the question <<How many family members does XXXXXX have? (This includes XXXXX, a spouse or partner, dependent children, and their dependent children.)>> ?
Shall i include step child or not in the family number count?

1. I would just choose parent.

2. Yes, your step-child must be included as a family member.

will be any extra documents regarding child custody will be requested from IRCC if he is not accompanying?

Even if non accompanying his medical, birth certificate passport will be required. Depending upon your case custody documents will be required.
