PR refused due to NOC difference

Hello everyone
I came to Canada in 2012 August under student visa and then got PGWP until april 2017.
I got invitation to apply for PR through EE under CEC.
Submitted all the documents through my lawyer in March 2017. And also applied for bridge work permit.
Unfortunately in August 2017 my application for PR came refused thereby my work permit being rejected.
The reason for refusal was not satisfying my duties under NOC6235, the officer categorized me under NOC6551. Immediately after the refusal I applied for reconsideration along with additional letters from my employer. It's been more than 2 months now after applying for reconsideration. I am currently jobless as I don't have legal documents for doing any job. I have also applied for restoration of visitor status.
My lawyer is now suggesting about going for federal appeal. I also contacted the local MP but they had nothing to do.
My family was with me for the past 3 years ( my wife and first child are PR dependent applicants). My second child was born in Canada and is a Canadian citizen. Bit currently they are out of Canada and not able to come back. My daughter is missing her school.
I also got suggestions for taking LMIA jobs.
Can someone help with this situation? Anybody went through similar situation?
Any suggestions on federal appeal?
Any help on LMIA jobs in Ontario?
Any help would be appreciated.

why can't you apply with the new category that the office suggested ? wouldn't that qualify you ?

Hello there,

I'm sorry to hear this. What was your job title? What were your duties? Why did you choose the code you used? What exactly did officer point out in rejection letter? This can help determine if you can appeal even though I heard it's expensive to appeal..stay strong.

So sorry to hear about that...I suggest you go for the appeal and at same time prepare for another application with your lawyer.
I know what you are going through now. It really sucks because your family has been in Canada for years and right now they cannot come back to you. Especially your children they are missing their school for sure.
My PR is still under processing after waiting for 14 months. I am in implied status and my family couldn't back to me for now either, and my little child is also missing his school so much. This is so hard for families.....

Im currently on implied status and cannot apply for a new one

Why is your application taking so long? I cannot file a new application because I'm currently unemployed as my work permit also expired. Which province are you in?

Hello why don't you reapply for express entry under the noc code recommended by the officer u will get pr

How long after AOR you are notified of the rejection? NOC 6551 is NOC C, which can't be used to apply under Express Entry. You may prepare both ways at the same time, one is to appeal through your lawyer, another one is to apply under paper based PNP which will take significantly longer, but at least got a chance.

The letter of reference, which describes job duties and responsibilities, is the single most important document in your application. Your lawyer should know this, and should have reviewed the duties and responsibilities to ensure they were adequately described for the NOC.

Given that your lawyer should have prevented this mistake, I'm not certain it is a good idea to continue with him/her.

I didn't have much idea about it. As I hired a lawyer I blindly followed her. Now my application is in federal court. Have anyone been through federal court procedures for PR appeal?

Just wondering where did u work to claim noc 6235? Bank Call centre ?
