I am from Afghanistan and since early 9os I have been living in US. I was admitted into the US as a student and eventually I was granted asylum almost 10 years ago. My spouse is a Naturalized US citizen. When I applied to get my green card my application was put on hold because of material support bars of US immigration law. In my asylum application I had disclosed that some thirty years ago when I was a teenager I had joined the Afghan Resistance forces who were fighting the Soviet occupation of Afghanistan. Under the US law Afghan Resistance groups, who were actually created and supported by the US government, are considered tier III terrorist groups and any affiliation with a Tier III terrorist group makes an individaul ineligible for immigration benefits in US. Few years ago the US Congress provided the Dep of Homeland Security with powers to grant group based/ individual wavier for applications that had been on hold for years. However, the current administration has stopped granting any more waiver through executive order. At the moment I have to renew my work authorization every year. I am very worried becuase the government can simply revoke my current asylum status without any reason not withsanding the fact that I haven been living and working here for more than two decades. Throughout my stay here I have never committed a minor offence except for a half dozen traffic citations. I had been able to obtain an undergarduate and a graduate degree without any assistance from the government. I have been able to establish a very successful business...but now I have reached a point in my life that it is becoming rather difficult to continue living here with such uncertainity.
I have been seriously considering moving to Canada for sometimes in a legal manner...however, the Safe Third Country Agreement makes it very difficult to move into Canada in a legal way...I have consulted a couple of attorneys in Canada and everyone cited the same agreement ...I have to mention that my brother in Law (wife's brother) is a legal resident of Canada...
I would appreciate any suggestion that can direct me to a possible light at the end of the tunnel a tunnel that seems too dark and dangerous at the moment...
