HI,

So my friends case is:

She worked in Canada from:
1. 5 December - 30 April - Full time- 40 hours : 0112 Human Resources NOC
2. 7 May onwards- Full-time - 30 hours - 0112 Human Resources NOC

She completes her 11 months on 7 Nov 2017 and her open work permit expires on 22 November. We believe there will be a draw on 1 Nov and 15 Nov.

What do we do?

Should we create her profile for 1 Nov or 15 Nov?

Is there any other way she can apply for a work permit extension? She will have to leave her job and exit the country on 21 Nov?

HI,
She worked in Canada from:
1. 5 December - 30 April - Full time- 40 hours : 0112 Human Resources NOC
2. 7 May onwards- Full-time - 30 hours - 0112 Human Resources NOC

She completes her 11 months on 7 Nov 2017

??? 11 months is the equivalent of 0 years. She is not eligible until she has worked 12 months.

and her open work permit expires on 22 November. We believe there will be a draw on 1 Nov and 15 Nov.
Should we create her profile for 1 Nov or 15 Nov?

Is there any other way she can apply for a work permit extension? She will have to leave her job and exit the country on 21 Nov?

Please indicate kind of work permit she is on, or whether she has explored any of the other options to obtain a work permit (Employer LMIA, IEC programs, etc.) It could also be important to indicate her country of citizenship.

She was a student- completed a 1 year course in Canada and got an open work permit for 1 year.

Can she apply basis her 11 months experience, then apply for a bridging work permit?

Is there any possibility for her here at all?

If she is rejected after submitting her papers, she will have her bridging application and would have completed her 12 months by then. Can she go back in the pool then?

Nothing stopping her from trying, as long as she understands that it might not succeed.

To be eligible for the BOWP, she would have to receive the ITA, submit the eAPR, and receive the email Acknowledgement of Receipt (AOR) while her work permit is still valid. Typically, people receive the email AOR within 24 hours of submitting the eAPR - up until and including the last day on her work permit, she can then apply for the BOWP. However, if the eAPR is deemed incomplete and returned, the BOWP application will also be deemed incomplete and she would be immediately (retroactively) out of status.

Has she taken the language test already? Have her police clearances? Those need to be ready to go if she has any hope of being eligible for the BOWP.

Added to what jes said if her BOWP is rejected for incompleteness then no implied status is granted, that is, her work experience after her work permit expiration won't be valid.

If her application is "rejected as incomplete," then she is out of status retroactive to the expiry of the original work permit.

If her application is accepted for processing, she succeeds with getting the BOWP, and she is later refused as ineligible, then yes, the experience would be valid and she could try again later.

And what is her citizenship, and has she asked her employer for an LMIA?

She has completed her IELTS as well as WES. This week she will get her medicals done.

Her visa expires on 22nd Nov.
I believe we should create her profile for the draw on 15th November. We have all her documents ready. As soon as she gets an invite we will submit all the documents. So by 17th Nov she should have her AOR and we can apply for BOWP.

We understand there is a possibility of rejection. By the time she would be rejected, she would have completed her 12 months by 5 Dec. What do we do then? Get back in the pool, receive an ITA and reapply for BOWP or exit the country and apply from your home country?

How do we know the above? By AOR? If she receives AOR we are good?

No, the AOR only acknowledges that the electronic submission of the application was received by IRCC.

If it is refused as incomplete, the application will be returned to you along with a letter, within 1-2 months of submission.

Oh ok.

So then her work experience remains as 11 months and she will have to exit the country and apply under FSW from India?

When will she have to exit? As soon as she receives AOR that says incomplete?
