No, your app would not be refused because of your child's autism.I should also mention my son does have mild autism (Asperger syndrome). Not sure if immigration will refuse my Permanent Resident application even though I DON'T have custody of my son. Does anyone know if this will effect keep my application being approved?
Solid plan. Make sure that your letter clearly states that you understand that your child will be excluded from the Family Class and therefore never be able to be sponsored; this is the most important part. Your app will not be refused because of this, so don't stress about that. IRCC is very familiar with this situation, as it happens much too often.I have until 10/28/2017 to give Immigration a response to my son's medical request. What I am going to do is make copies of all emails sent to her and my son, make copy of lawyer emails and make copy of the tracking information and letter i mailed to her. Than I will write a letter explaining how I never had custody of my son; how i tried to comply with immigration request to get a non accompany depend medical completed; explain how I tried to communicate with her to get my son to either get a medical done or their refusal to do a medical; and how she refuses to answer any my of communication request. Get the letter notarized (I'm in Canada so I am not sure if they have notaries or what they have) and put all of this information as a back up. Hopefully immigration will not refuse my Permanent Resident application.
When we sent in our notarized declaration asking to waive the kids medicals, we only sent in the letter. I made sure it had all the file info on it, name, dob, uci number.Hello everyone,
I just want to thank everyone for their input and information. Because of the information everyone has shared with me, I was able to formulate a plan on how to proceed. I have sent my sons mom three email, a type letter with a tracking number and consulted a family lawyer in here home state. The lawyer is going to send me an email with some a outline of options so I have make an informed decision. I will send some more emails to her asking her to consider giving me a respond of their refusal to get his medical exam. I expect her NOT to respond to any of my request. She is a very protective parent; has a history of being difficult and not communicating with me for weeks or months at a time.

I am so grateful for everyone’s help. I was just wondering since I have only 30 to respond back to immigration for my sons medical. His mother refusing to even acknowledge my communication sent to her. How many time do you think would enough to demonstrate her unwillingness to get my sons medical. I have sent three emails, consulted a lawyer and sent a certified letter. Do you think is enough times to try to get a hold of her or should I try a couple more times?

I am just give a up date, I sent a certified letter to my son mother. It looks like she is not even going to sign for the letter and it is going to be sent back to me. Not sure if this will help my cause to show immigration my efforts to convince my son mother to ask her if she will let him get his medical done. Any input on this matter would be greatly appreciated.

Yes just send in your notarized declaration of being aware and accepting that you will never be able to sponsor your son, how you tried to contact her and all the proof you have gathered. If you have any paperwork showing she has full custody, send that as well.Hello everyone,
I just need a little clarification on my letter I’m sending to immigration about my sons mom not responding to my correspondences to get his medical. Is there some sort of form that immigration will require me to fill to accompany my letter? Or do I understand correctly all I need is a letter with all the attempts to get a hold of her and I will never be able to sponsor him to come to canada.
