Citizenship Applications after Bill C-6

Hi, Our PR cards are expiring end of November 2017. We plan to apply for Citizenship next month. Do we need to renew our PR cards, even we have no short term plan to travel out of Canada .

Guys, I just (last week) completed the 4 years out of 6 years to become eligible to apply for Canadian Citizenship. My wife & daughter have already applied for citizenship & have received AOR.

With the speculation around implementation of C-6 in Fall (Sept 21st), I am tempted to wait for a few more days so that there is absolutely no chance that I fall short of days & I am able to prove that I have much more than met the requirement of physical presence.

That said, the implementation of 3/5 rule could take several more weeks & things could drag all the way into December for CIC to start accepting applications. With that possibility, I wonder whether or not it is worth the while to apply now under the 4 year rule that I qualify under as well.

It is my belief that many people in anticipation of the implementation of Bill C6 have stopped sending their citizenship applications & this will probably expedite the processing of applications made in 4/6 rule. Plus, once CIC starts accepting applications under 3/5 rule - there will be a mad rush from all those applicants that suddenly become eligible (applicants that were otherwise going to wait for 1 more year).

I wonder whether CIC is already looks for only 3 years of physical presence in even an application made under the 4/6 rule. CIC may only be accepting application from people that have met 4 years of physical presence in the last 6 years however they may apply the stringent physical presence test only to the extent of 3 years.

The point to keep in mind is that Bill C-6 has already been passed & any application that CIC challenges solely for lets say a few days short from 4 years cannot be refused.

I am not sure whether or not my thinking is appropriate & would like others to comment.

Wait a few more days to have a comfortable buffer and apply. C6 implementation date should have no impact on your decision to apply now or later.

I am not sure if you are correct in assuming people who are eligible are waiting for C6. I would guess most people are trying to apply before C6 is implemented if they eligible to make sure their application is in before the flood (people who require 3/5 to apply). IRCC still operates mostly in first come first serve basis.

Always a good idea to renew the card.
You never know when there is an emergency that would require your to travel out of Canada. The processing time is also out of your control and could take up to a year (current average estimate on IRCC website). Do you really want to be restricted in movement for upto a year?

I am far from my PR expiring, but just out of curiosity and if it comes to it, what is the fee to renew the PR?

on CIC, I see that there is a $50 charge for getting a PR card. is that same as renewal or do I need to pay the full 1000-odd dollars?

I don't think this is correct. Applications are processed with the rules prevailing at the time of receipt of application. If an application is received under 4/6, it will have to qualify under 4/6 rule, even if C6 kicks in.

2004-2005: university (stayed minimum 200 days in canada)

2007-2008 : university study permit (stayed minimum 200 days in canada)

2015-2017 : work permit (stayed over 500 days)

august 2007 : become a permanent resident under express entry

by looking at these figures, currently i have 1100 days that i have stayed in canada.


will this be accepted by under the new regulation?

You became PR in 2007 but you had a work permit between 2015-2017? There is a discrepancy in your account.

As has been pointed out already, you cannot count any days that are more than five years in the past. Also, you have to sum up the days before your PR that are not more than five years ago and divide them by two. Whatever you get, if it is more than 365, you can only count 365.

Most importantly, the golden rule is:

You can never be eligible for citizenship until you have been a Permanent Resident for two years, even if you never left the country and have been living here for decades.

She will need to provide a police certificate if she's residing in any other country but Canda for 6 or more months. It's a good idea to read the citizenship instruction guide available on CIC. It has all the answers you seek.

Would that be 183 days in a year out of the country or 183 days within the 5 year time period?
I've been out of the country for a total of 350 days spread in four trips outside Canada in approximately 4 years and none of which was more than 180 days. Should I get a Police Clearance certificate as well?

"In the past 4 years, were you present in a country, other than Canada, for a total of 183 days or more?" - this is what it says on the application form. and I'll definitely need a Police Clearance certificate unless the new forms drop this.
