Hello,I am a rejected refugee claiment I am going to apply for H&C next week, main arguments : family ties in canada ( parents and 3 siblings are Canadian Citizens) Best interest of child ( younger brother is 13 years old canadian) establishment in Canada ( being lived in Canada sine DEC 2013 been working since Apirl 2015 with same employer "stable employment" Adverse Country conditions "Lebanon" ( political instability, poor economy, humanitarian crisis due to entry of more than one million syrian refugees into Lebanon) personal risk ( Hezbollah is still looking for me in Lebanon and wants to kill me, I obtained a letters from two friends in Lebanon that post dates my refugee hearing and confirming that Hezbollah has made an inquiries about me in my previous place of residence)
Do you believe I have a strong case and what are my chaces of H&C succeed.???

Best Regards,
Naji

Best interest of the child means best interest of your children not a brother. Unfortunately unlikely unless you can gather a lot more proof of why Hezbollah is looking for you and persecution you received from them or other groups while you were in Lebanon.

My lawyer told me that the best interest of child applies to any child affected by the removal of the applicant not necessary to be only of a parent and a child

Normally applies to your children or children in your care. Not being around for your younger brother when he has all his other siblings and parents is not really a good argument for H&C unless you have been his primarily caregiver for most of his life and he has specialized needs.

Unfortunately that means nothing. Your brother may be sad if you can't stay but it is not grounds for you to stay.
Whats about family ties in Canada all my immediate family are Canadian citizens , I have no more family members in my country of Citizenship

You are a young adult so you can survive on your own unlike someone young or elderly. You have no aunts, uncles, cousins, grandparents in Lebanon?

H&C is extremely difficult to achieve in a lot of cases, and seems in a lot of cases, a last desperate attempt to remain in Canada. Personally, I think there are too many variables (the reviewing officer(s), external influences (yes, best interests of the child can be applied), the reasons for you refugee refusal, family in Canada, how established and stable you are, etc for anyone to actually suggest you will or will not be successful. My personal suggestion is to take everything everyone say (including your lawyer who makes money from you) with a grain of salt. Take the personal initiative to understand the op's manuals and Canlii cases similar to yours for some insight and knowledge about what affects the decisions in these claims. It likely going to be a long process, so start thinking like IRCC and address the concerns they may have, in advance.
